External Diligence performed on 15 May 2007 at a garage on Rua Manuel Joao Paulo Rocha in Lagos by two PJ Inspectors.

Within the scope of the house search at the residence of the arguido R.J.Q.E.Murat on 14 May, last, a “Yale”-type key was seized which was on a metal keyring with a plastic label holder on which was written “Garage 4”.
Attempting to obtain a definite address to which the object pertained, an informal conversation was carried out with Robert Murat in which it was determined that the garage was situated in a residential zone, specifically on Rua Manuel Joao Paulo Rocha, in the city of Lagos, and that it was used to store various materials.
When the arguido was told that it was necessary to search that location he made himself immediately available to accompany members of the PJ such that the garage was located and duly searched.

Today, as ordered, we went to the city of Lagos to determine the various residences used an/or owned by R.Murat or his family members.
--- Having gone to Elras Velhas behind the Celero restaurant, next to the EN125, in Almadena, it was possible to speak with a resident of the area having land next to Elras Velhas, who affirmed knowing Murat very well, having given him exclusive rights to sell some land when he worked for the Remax estate agency, and that his [RM's] mother had sold her Elras Velhas property long ago, not knowing exactly how long ago but he was sure it will have been during RM's divorce.
--- Visually checking the mail boxes outside the property the names of R.P.Harris and R.Elliot were noted.
--- At the address of Urb. Chesgal ... in Lagos it was possible to determine from the owner of the ground floor apartment that the referred apartment had been acquired by an individual named Miguel about 10 (ten) years ago, she also having stated that she remembers that the first owner had been a foreign female not knowing her nor remembering her name.
--- At Rua do Jogo da Bola - Lagos, it was not possible to locate the "Bora" café or any other commercial establishment. That café was then found on Rua Conselheiro Joaquim Machado in Lagos, the proprietor of which, in conversation, stated that he did not know R.M. nor had he ever seen him frequent id establishment.
--- With the intention of location Quinta do Sto. Phunurius, it was possible to verify that it was in Rua D. Joao III in Ameijeira - Lagos, and in conversation with several residents it was possible to determine that it was a Quinta [farm estate] owned by an English citizen and managed by a North American man who lives at Travessa do Forno in Lagos, the people also having stated that the Quinta is used for "parties" of a sexual nature.
--- It was not possible, however, to determine if R.M. currently frequented that Quinta.
--- Nothing more was recovered of interest to the present investigation.

Inquiry carried out by Inspectors Rui Fernandes and Ricardo Paiva

Description and results of Inquiry

On this date at about 15.00 we went to Kelly’s Bar, located in Rua da Calheta, in Praia da Luz. At the site we were received by an employee of the bar identified as L***** A**** M**** who had been on duty on the night of 3rd May 2007.

When questioned whether on the night in question she remembered the visit to the bar by witness Martin Smith and his family, she replied that she does not remember given the lapse of time between the events and because the bar is daily frequented by dozens of clients of different nationalities.

All the available documentation was requested concerning the expenses in the bar on the night of 3rd May 2007 as we were given the cash register from which photocopies were made referring to the period between 20.00 and 24.00, which is annexed to this report.

External Inquiry Report


Description and Result of Inquiry

On this date, and following the sequence of inquiries already undertaken, we went to Praia da Luz, specifically to the The Dolphin Restaurant, situated on Rua da Calheta, No. 14 A, where we contacted the owners, identified as Adrianne Jacobus van Marais, holder of Residence permit number XXXXXXX - of South African nationality, whom we showed the photo-fit created according to the indications of a witness identified in the inquiry, and asked this witness whether had seen someone similar using the telephone in the PT booth situated in front of the restaurant;---
As this witness's residence is located above the restaurant, the same photo-fit was shown to his wife, Lizelle Joubert Marais, holder of identity card no, xxxxxxxx-x, who immediately informed us that she recognized the individual who had gone 3 or 4 times to the telephone booth and on another occasion passed the restaurant.
When questioned, she said that individual was always dressed in white trousers, which were rather dirty, and a dark-coloured winter coat. She always saw him on foot and alone.
Questioned further, she states that she saw him during the course of last week, not remembering on which days, but guarantees that he did not return after the dates in the present event under investigation
Various telephone numbers were provided so that the police could contact them in the case of further questions.
The telephone booth is located on Rua da Calheta and has the number 282 789 210;---
Nearby, in the Rua Helena do Nascimento Batista, we located another telephone booth corresponding to number 282 789 111;with nothing else to be investigated, this inquiry was terminated.
