Activity description and result:
----- According to what was reported in the preceding I.S. (Service Information docket), there were tennis coaches who gave tennis lessons at the Ocean Club resort, those being Luis Machado - contactable by mobile phone at 934***329 and Vasco Portas.
----- Contacted Sr. Luís Machado, the same made himself available to appear before the M.P. of Lagos in order to be questioned.
----- Also Sr. Vasco Portas, identified as VASCO SALES PORTAS, was notified to appear before this DIC, it having resulted in his questioning, as per the following official document [witness statement].
----- A team went to the abovementioned M.P. of Lagos, where there proceeded the formal questioning of the witness Luis Machado, identified as LUÍS FILIPE DE CASTRO CABRAL MACHADO.
----- From those questions we succeeded to determine that both Luís Machado, and Vasco Portas, had no contact with the McCann family or with any member of the group of which they were a part.
----- It is clear from Luís Machado that the resort, named The Ocean Club, receives customers of two different tourist operators: JONATHAN MARKSON e MARK WARNER.
----- As for the tennis coaches, in reality the above witnesses, both Luís Machado and Vasco Portas, clarify that they work directly for JONATHAN MARKSON, while the McCann family, and their respective group, were customers of MARK WARNER.
----- The witness Luís Machado relates that he knows the tennis instructors of MARK WARNER by the names of GEORGINA and DANIEL, commonly known as DAN, but he has no contact details for them, suggesting that the Ocean Club reception might be bale to provide that information.
----- Concluding the questioning, and in possession of the information collected, we went to the Ocean Club resort where we succeeded in contacting the abovementioned GEORGINA e DAN, since both were in the resort area.
----- They were identified as GEORGINA LOUISE JACKSON and DANIEL JAMES STUK and were formally questioned, as per the official dockets that follow [succeed] this OAR [outside activity report].
----- Both had contacted the McCann famíly within the ambit [scope] of their functions, namely, as their tennis instructors, affirming that the McCann couple was particularly enthusiastic about the sport, such that they had lessons each day and several times a day.
----- Little Madeleine participated, as well, in a group children's lesson.
----- Both the tennis instructors affirmed that they had not observed any situation that was strange, different or relevant to record in these case file documents, it being that the whole holiday group [T9] retained a normal comportment [behaved normally] and in the same manner as any other group of friends on holiday.
----- I post [submit] this, given the conclusion [end of] the present activity

----- Conforme consta em I.S. que antecede, foram indicados os instrutores de ténis que prestam aulas no Ocean Club resort, como sendo Luis Machado - contactável pelo telemóvel 93473#### e Vasco Portas. ----- Contactado o Sr. Luís Machado, o mesmo mostrou-se disponível para comparecer no M.P. de Lagos, a fim de ser inquirido. ----- Também o Sr. Vasco Portas, identificado como VASCO SALES PORTAS, foi notificado para comparecer neste DIC, tendo-se procedido a sua inquirição, conforme Auto que segue. ----- Deslocou-se a equipa acima indicada ao M.P. de Lagos, onde se procedeu a inquirição formal da testemunha Luis Machado, identificado como LUÍS FILIPE DE CASTRO CABRAL MACHADO. ----- Destas inquirições, lográmos apurar que, tanto o Luís Machado, como o Vasco Portas, não tiveram qualquer contacto com a Família McCann ou qualquer elemento do grupo onde se inseriam. ----- Esclarece o Luís Machado que o resort, denominado The Ocean Club, recebe clientes de dois operadores turísticos diferentes: JONATHAN MARKSON e MARK WARNER. ----- Quanto aos instrutores de ténis em concreto, esclarecem as testemunhas acima indicadas que tanto o Luís Machado, como o Vasco Portas trabalham directamente com a JONATHAN MARKSOIV, sendo que a Família McCann, e o respectivo grupo, eram clientes da MARK WARNER. ----- A testemunha Luís Machado refere que conhece os instrutores de ténis da MARK WARNER pelos nomes de GEORGINA e DANIEL, habitualmente tratado como DAN, mas não possui qualquer contacto dos mesmos, sendo que, na recepção do Ocean Club, podem indicar esse dados. ------ Finda a inquirição, e na posse da informação recolhida, deslocámo-nos ao Ocean Club resort, onde lográmos contactar os referidos GEORGINA e DAN, pois os mesmos encontravam-se no recinto do resort. ----- Foram identificados como GEORGINA LOUISE JACKSON e DANIEL JAMES STUK e formalmente inquiridos, conforme Autos que sucedem ao presente RDE. ----- Ambos contactaram a família McCann no âmbito das suas funções, ou seja, na qualidade de instrutores de ténis, afirmando que o casal McCann era particularmente aficionado do desporto, pelo que marcaram aulas diariamente e várias vezes por dia. ----- A pequena Madeleine participou, inclusive, numa aula infantil de grupo. ----- Ambos os instrutores de ténis afimaram que não observaram qualquer situação estranha, diferente ou digna de registo a relatar aos autos, sendo que o grupo onde se inseria a Família McCann sempre deteve um comportamento normal e em moldes iguais a qualquer outro grupo de amigos em férias. ------------

He is a functionary of [employed by] the tourist operator Mark Warner, working as a tennis instructor in the precinct of the Ocean Club resort

Asked, he relates that he usually works from 09:00 to 19:30 and has his day-off on Saturday.

Asked, the deponent relates that the only tennis instructors of Mark Warner are himself and his colleague called GEORGINA.

The deponent started to work in Portugal, in the indicated functions and place, on 23 March last, having concluded a contract with Mark Warner in England with those conditions.

Questioned, he relates that he knew the McCann family as part of his work, since he gave them tennis lessons, as a couple, parents of the missing Madeleine, as well as the other couples who accompanied them.

He reports that the group iniciated contact with the tennis instructors on the 29 April, the day immediately after their arrival at the Ocean Club.

His colleague Georgina has the calendar of classes given by her and by him to the McCann couple.

He relates that a first lesson of instruction was done in the morning of 29 April, it being that, on that day, they had no more lessons.

On the following days the parents of Madeleine, whom the deponent identified as Gerry and Kate McCann, scheduled 16 tennis classes, together and/or separately, at different times of the morning or afternoon, classes that were conducted by either him or by Georgina depending on their booking calendar.

Questioned about the class times of G&K McCann on last Thursday, 3 May, he related that the mother of MBM had a group class at 09-10h00 conducted by Georgina; the father had a group class at 10-11h00 conducted by him.

Later, at 15-15h45, the couple had a private class, together, conducted by him - and finally, GM participated in the men's social tennis event at 18-19h00.

Questioned about whether, yesterday, he had conducted tennis lessons for an individual called Jeremy Wilkins, who was commonly known as Jez, the deponent relates that that individual booked, and attended, some tennis lessons and that all of those had been given by him.

He relates that, as they had group lessons together GM and Jez had had some conversations, but he thinks that it is only because they shared some classes and that those [conversations] will not have given rise to a firm friendship, but rather to a simple acquaintanceship due to which they would have conversed when they met each other.

Questioned about the couple and their behaviour, both between the family and with the other group members, the deponent relates that he never noted any issue between them, and that the behaviour of everyone was like any other group of tourists that take their holidays in the resort every day.

There never appeared any problem between them and other people. It being asked of him, the deponent relates that the McCann couple and the remaining group members had often been together, not always all of them, but the majority of the people were sociable with each other.

He relates that they spent most of the day within the OC resort, in the pool, also they went to the beach but they did not use any of the OC activities there, and they centered their attention on the developed activities of the resort, it being that the couple preferred, unquestionably, tennis.

The four couples had children who were, for part of the day, under the care of the child care workers of the Ocean Club.

Questioned, he relates that he does not know where the group took their meals or under what circumstances.

Asked if at some time he was aware of the presence of some individual who had watched the group, whether the adults or the children, he relates that no, he never had the perception of any situation that aroused his curiosity and that everyone acted normally just like any group of friends on holiday.

Because it was asked of him, he relates that he knew about the disappearance of little MBM that same night, about 22h20, because he was contacted by a resort worker having attended and partcipated in the searches.

Prompted, he affirms that he has no further useful information that might help in locating MBM or that may have led to the disappearance.

Vir aos autos na qualidade de testemunha. ----- Em virtude da testemunha ser de nacionalidade inglesa e não dominar a língua portuguesa, as presentes declarações são tomadas na presença de Robert James Queriol Eveleigh Murat, tradutor nomeado nos presentes autos. ------
-- -- -- É funcionário do operador turístico Mark Warner, exercendo as funções de Instrutor de Ténis no recinto do empreendimento Ocean Club. ----- Perguntado, refere que trabalha normalmente no horário das 09h00 as 19H30 e tem a sua folga ao sábado. ------ Questionado, o depoente refere que os únicos instrutores de ténis da Mark Warner, são o próprio e uma colega, de nome GEORGINA. ----- O ora depoente começou a trabalhar em Portugal. ja nas funcoes e local indicados, no preterito dia 23 de Marco, sendo que estabeleceu o contrato com o Mark Warner em Inglaterra, já nestas condições. ------ Questionado, refere que conheceu a familia McCann no âmbito das suas funções, pois ministrou-lhes aulas de ténis, quer ao casal, pais da desaparecida Madeleine, bem como aos outros casais que os acompanhavam. ------ Reporta que o grupo iniciou os seus contactos com os instructores de Ténis no dis 29 de Abril p.p., o dia imediatamente seguinte à chegada do grupo ao Ocean Club. ------ A sua colega Georgina possui o calendário das classes ministradas por ela e pelo depoente ao casal McCann. ------ Refere que foi feita uma primeira aula de instrução, na manhã 29 de Abril, sendo que, nesse dia, não tiveram mais aulas. ------ Nos dias seguintes, os pais da Madeleine, que o depoente identifica com GERRY e KATE McCANN, agendaram 16 aulas de ténis, em conjunto e/ ou separado, a diferentes horas da manhã ou tarde, aulas que foram ministradas quer por si, como pela Georgina, dependendo do calendário de marcações de cada um. ------
-- -- -- Questionado sobre o horário das aulas de Gerry e Kate McCann na pretérita quinta-feira, dia 03 de Maio, relata que a mãe de Madeleine McCann teve uma aula de grupo às 10-11h00, ministrada por si. ------ Depois, pelas 15-15h45, o casal McCann teve uma aula privada, em conjunto, ministrada por si. ------ Por fim, Gerry McCann, participou num evento social masculino, relacionado com a prática do ténis, pelas 18-19h00. ------

Refere que passavam a maior parte do dia no recinto do Ocean Club, na piscina, também se deslocavam à praia, mas nao usavam as actividades do Ocean Club na praia, e centravam as suas atençòes nas actividades desenvolvidas no resort, sendo que o casal McCann preferia, inquestionavelmente, o tenis. ------ Os quatro casais tinham filhos, os quais permaneciam, durante parte do dia, aos cuidados das amas que prestavam serviço para o Ocean Club. ------ Questionado, refere que desconhece onde o grupo fazia as suas refeições diárias e um que condições. ------

Asked if at some time she was aware of the presence of some individual who had watched the group, whether the adults or the children, she relates that no, she never had the perception of any situation that aroused her curiosity and that everyone acted normally just like any group of friends on holiday.

Because it was asked of her, she relates that she knew about the disappearance of little MBM that same night, about 22h20, because she lives in the same house as another OC worker and (s)he told her.

Prompted, she affirms that she has no further useful information that might help in locating MBM or that may have led to the disappearance.

(10-11h00), aula essa inserida num grupo para crianças, ministrada pela depoente. - Quanto aos pais da criança, refere que foi feita uma prímeira aula de instrução, na manhã 29 de Abril, sendo que nesse dia não tiveram mais aulas. ---- Nos dias seguintes, os pais da Madeleine, que a depoente identifica como GERRY e KATE McCANN, agendaram 16 aulas de ténis, em conjunto e/ ou separado, a diferentes horas da manhã ou tarde, aulas que foram ministradas quer por si, como pelo DAN, dependendo do calendário de marcações de cada um. ------
-- Questionada sobre o horário das aulas de Gerry e Kate McCann na pretérita quinta-feira, dia 03 de Maio, relata que A mãe da Madeleine McCann teve uma aula de grupo as 09-10h00, ministrada por si. ----- O pai, Gerry McCann teve também uma aula de grupo as 10-11h00, ministrada pelo Dan. ----- Depois, pelas 15-15h45, o casal McCann teve uma aula privada, em conjunto, ministrada pelo Dan. ----- Por fim, o Gerry McCann, participou num evento social masculino, relacionado com a prática do ténis, pelas 18-19h00. ------
----- Questionada sobre se também ministrou aulas de ténis a um indlvi'duo de nome JEREMY WILKINS, a quem chamavam habitualmente por JEZ, a depoente refere que este indivíduo marcou, e compareceu, em algumas aulas de ténis, mas todas elas foram ministradas pelo Dan. ----- Refere que, por terem aulas de grupo juntos, o Gerry McCann e o Jez mantiveram algumas conversas, mas pensa que seja apenas pelo facto de partilharem algumas aulas e que tal não terá dado origem a qualquer tipo de relacionamento de amizade, mas sim um simples conhecimento que advém de serem ambos britânicos em férias no mesmo local, terem ambos filhos pequenos e partilharem algumas aulas de ténis, ------
---- Questionada sobre o c& e o seu comportamento, quer entre a família, como com os restantes elementos do grupo, a depoente refere que nunca notou qualquer questào entre eles, e que o comportamento de todos era como qualquer outro grupo de turistas que diariamente passa as suas férias no recinto. ----- Nunca se apercebeu de qualquer problema entre eles ou com outras pessoas. ----- Por lhe ser perguntado, a depoente refere que o casal McCann e os restantes elementos do grupo tinham por hábito estarem juntos, nem sempre todos, mas a maíor parte das pessoas convivia geralmente entre si. ---- Refere que passavam a maior parte do dia no recinto do Ocean Club, na piscina, também se deslocavam a praia, mas não usavam as actividades do Ocean Club na praia, e centravam as suas atenções nas actividades desenvolvidas no resort, sendo que o casal McCann preferia, inquestionavelmente, o ténis. ----- Todos os quatro casais tinham filhos, os quais permaneciam, durante parte do dia, aos cuidados das amas que prestam serviço para o Ocean Club. ----- Questionada, refere que não sabe onde eles habitualmente almoçavam, e que, a hora do jantar, a depoente já não se encontrava nas instalações do Olean Club, embora tenha ouvido dizer que eles jantaram, todas as noites à excepção do dia de chegada, no restaurante TAPAS, junto a piscina. ----- Também lhe disseram que, ao jantar, o grupo era apenas composto pelos adultos, pois as crianças ficavam nos apartamentos, mas a depoente nunca presenciou tal. ------
---- Perguntada se alguma vez verificou a presença de algum indivíduo que observasse o grupo que os McCann integravam, quer os adultos ou as crianças, refere que não, nunca teve a percepção de qualquer situação que lhe salientasse a sua curiosidade e que todos eles agiam normalmente, como qualquer grupo de amigos em férias. ----- Por lhe ser perguntado, refere que teve conhecimento do desaparecimento da pequena Madeleine na própria noite, cerca das 22H20, pois reside na mesma casa com outra funcionária do Ocean Club e foi-lhe comunicado o facto. ------
----- Instada, afirma que não possui qualquer informação útil que possa contribuir para a localização da Madeleine McCann ou quais as circunstância que conduziram ao seu desaparecimento. ------

His clients are mostly British. He has few clients from other nationalities. Tennis lessons normally run in the morning, between 09H00 and 12H30, but it is possible to give lessons in the afternoon but these are limited to when clients specifically ask for them
Nearly all of his students are residents, temporary and not, of the “Ocean Club"....
He clarifies that the company where he (the deponent) works, "Mark Warner", proprietor of the resort, also has its own tennis instructorsHe adds that "Mark Warner" has as its “base” tennis courts next to the Tapas restaurant and that it is rare for him to use other courts
Questioned, he says that during the past week (29 APR 07 to 05 MAY 07) he had four students who are listed on the fax which he has handed over to the authorities conducting this investigation

Questioned, says that he only became aware of Madeleine’s disappearance following television reports and ascertains that he never saw the child in person. He does not know if they were tennis students as they were never his students-Having given him the names of the group with Madeleine, he says that he is certain that none of them were his students.
When questioned, he says that during the past week he did not have a student named “JEREMY” or anyone by the name of “JEZ. He affirms only having knowledge of Madeleine’s disappearance from the media. 10. Esclarece que para além da empressa onde o ora depoente trabalha, a
11. “markwarner”, proprietária do resorf, tem também os seus próprios professors de

13. Acrescenta que a “Markwarner”tem a sua “base” de tennis instalada junto ao
14. Restaurante “tapas”, sendo raras as vezes que utilizam os outros courts. ------
15. Perguntado, disse que durante a passada semana (29 ABR 07 a 05 MAI 07) teve
16. apenas teve 04 alunos, os quais se encontram descriminados no fax cuja cópia
17. fornece neste acto para os autos.------
18. Perguntado, disse só ter conhecido os pais da desparecida MADELEINE através
19. da televisião, sendo certo que nunca viu a menina pessoalmente.-----
20. Desconhece se estes eram practicantes de tennis, pois, nunca foram seus alunos.
21. Sendo-lhe indicado os nomes das pessoas pertencentes ao grupo onde se
22. inseram os progenitors da MADELEINE, disse não conhecer nenhum deles,
23. sendo certo que não foram seus alunos.-----
24. A pergunta feita, disse que durante a última semana não teve qualquer aluno de

-----Comes to the process as a witness, in the sequence of the fact that he exercises his functions as a part-time tennis instructor. For this reason, he normally offers classes in one of the courts in the resort complex known as the "Ocean Club Garden".
----- The question made, states that he reside in the ***** zone of Luz for about 15 years where he has worked in the profession above referenced. He is the owner of a restaurant in Rua da Praia called “António", and on a part-time basis works as a tennis instructor.
----- Relative to the first of his occupations, he states that the family in question [McCanns] never entered/frequented his establishment. As he understands it, food and drink are included in the tourist packages bought by the clients through the tour operator Mark Warner and this is what the family of the missing girl MADELEINE MCCANN did when they came to Praia da Luz.
-----He also vaguely remembers having seen the minor with her respective family in the immediate vicinity of his establishment during their stay in Praia da Luz.
…….On the other hand, questioned regarding the possibility of having giving lessons to the parents of said child, the deponent negates peremptorily that he did so.
----- On this vein, the deponent does remember the building in which the McCann family stayed and which is operated by "Jonathan Markson" and "Mark Warner". He adds that he only works with clients from these two operators.
----- Consequently, he denies that at no time did he administer any classes to the father of the minor, GERRY McCANN or KATE HEALY.
----- For this reason, he is not aware of any related incidents either with the family in the building above referenced or with the facts that are being investigated.
----- At the same time, confronted with the identities of the other elements of the McCann group (namely the couples comprised of RUSSEL O’BRIEN and JANE TANNER, MATTHEW OLDFIELD and RACHEL MAMPILLY, and DAVID PAYNE and FIONA PAYNE), he denies that there is a possibility that he at any point administered lessons to any of them, be they group or private lessons.
----- Regarding the possibility of having administered classes/lessons to an individual whose name is JEREMY MICHAEL WILKINS, also known as "JEZ",the deponent denies having done so and states that he never encountered such an individual
----- Asked to reveal the identities of the instructors who were charged with giving tennis lessons to “MarkWarner” clients, the questioned referred to a supposedly British citizen whose name is GEORGINA and to an individual who goes by the name of DANIEL or DAN.

----- Asked to reveal if there are any other details of incidents that would be pertinent to the clarification of the facts in question, the deponent states that he cannot state any.

7. referenciadas: é emprasário do ramo da restauração (sendo proprietário de
8. um Restaurante sitop na Rua da Praia, denominado “Antonio”), e exerce em
9. regime de part-time a já citada ocupação de Professor de Ténis.-----
10. -----Relativamente a primeira de tais ocupações, refere que a famila da
11. ofendida nunca terá frequentado o seu establecimento, ao que julga
12. devido ao facto das refeições estarem incluídas nos pacotes turísticos
13. adquiridos pelos clients do operador através do qual a fanília da
14. recentemente desparecida MADELEINE McCANN terá vindo para a Praia da Luz
15. – a saber, a “Mark Warner”.-----
16. -----Ainda assim, refere ter uma vaga ideia de ter visto a menor e
17. respectivos familiars nas imediações do seu establecimento, por ocasião
18. da sua ida à Praia da Luz.-----
19. -----Por outro lado, perguntado acerca da possibilidade de ter
20. ministrado aulas de tennis aos progenitores daquela menor, o depoente
21. negou peremptoriamente que alguma vez o tivesse feito. -----
22. -----Nesse sentido, o depoente lograria escalaracer que o empreedimento
23. no qual havia ficado instalada a família McCANN é utilizado pelos
24. operadores turísticos “Jonathan Markson” e “Mark Warner”, acrescentando
25. que apenas trabalha com os clients do primeiro deste operadores. -----
26. -----Por conseguite, nega que alguma vez tivesse ministrado quaiquer
27. aulas, quer ao pai da menor MADELEINE McCANN, GERALD McCANN, quer á mãe,
28. KATE HEALY. -----
29. -----Em razão desse facto, desconhece quaisquer incidências
30. relacionadas, quer com a estadia daquela família no empreendimento acima
31. identificado, quer com os factos que ora se pretendem investigar.-----
32. -----Do mesmo modo, confrontado com as identidades das restantes
33. famílias que acompanhavam a família McCANN nesta deslocação a Praia da
34. Luz (designadamente, os casais compostos por RUSSELL O’BRIEN e JANE
35. TANNER, MATTHEW OLDFIELD e RACHEL MAMPILLY e DAVID PAYNE e FIONA PAYNE),
36. negaria a possibilidade de alguma vez lhes ter ministrado quaisquer aulas
37. e ainda, que com os mesmos tivesse privado. -----
38. ----- Indagado acerca da possibilidade de ter ministrado aulas a um
39. indivíduo de nome JEREMY MICHAEL WILKINS, mais conhecido por “JEZ”, o
40. depoente negaria outrossim tê-lo feito, referindo nunca ter privado com

42. -----Instado a revelar a identidade dos Professores que estariam
43. encarregados de ministrar aulas de Ténis aos clientes da “Mark Warner”, o
