Witness statement of Kate Marie Healy, on the 6th of September 2007, at 3 p.m.
Location: CID Portimão

Comes to the process as an assistant.

Of British nationality, the assistant cannot speak or write Portuguese, therefore an interpreter is present, Armanda Duarte Salbany Russell, chosen by the assistant from a list provided by the Consulate.

Also present is Dr. Carlos Pinto de Abreu, attorney.

The assistant confirms the full contents of her statement given to this police force on the 4th of May 2007, the day following the events under investigation.

When asked about the 1st of May 2007, a holiday, she says that on that day they left the apartment around 8:30PM, the same time that was repeated every night. That time was scheduled at the restaurant as the start of dinner, except on Saturday, the day of arrival, when they had dinner at the Milénio restaurant. On that day, May 1, the children were asleep, as she put them to bed at around 7:15/7:30 and was sure they were sleeping.

They arrived at the Tapas at around 8:31, taking the direct route, i.e. left by the balcony door, went down to the road and entered the resort’s secondary reception. As they left by the balcony door, this door remained closed but not locked, as this is only possible from the inside. The curtains were closed.

When they arrived at the Tapas, she thinks that nobody from the group was there, but is not sure.

During dinner, every half hour they went to the apartment to check on the children. This was done by the deponent and by Gerry. She does not remember if on this night any of their friends went to the apartment. She states that Russell was not present during dinner, so his wife Jane, or somebody else took his dinner to the apartment. The reason for his absence was that their youngest daughter was sick.

When asked, the assistant said that dinner ended at around 11 p.m., and together with Gerry, she left for the apartment.

She thinks they went to the flat four times, one every half hour: Gerry twice and herself twice, at around 9, 9:30, 10, and 10:30 p.m.

When asked about the fact her daughter had been crying on Tuesday night for one hour and 15 minutes, between 10:30 and 11:45 p.m., she says that is not true. She says that on that night, after midnight, Madeleine went to their room and said that her sister Amelie was crying, so she stayed to sleep with her and Gerry in their bedroom. She says that before Madeleine appeared in her bedroom, she had already heard Amelie crying, however she did not go to the room, as Madeleine came into the room almost at the same time she heard the crying. She does not remember if afterwards she, or Gerry, went to the children’s room, however she asserts that Amelie cried for a short time.

When asked, she says that on that night the twins slept in the bedroom where Madeleine slept, each in their own cot.

When questioned about the apartment’s layout, she said that on the first day the moved the furniture: they moved the two cots out of their bedroom and put them in the other one, where the children were to sleep, after they pushed the two single beds in that bedroom apart. They also pushed the two single beds in their bedroom together. She presumes that the cots, when in their bedroom, were at the beds’ bottom.

She mentions that when she arrived there not two, but three cots, in the same spot, and she believes that one was lent to the Payne family.

When shown a diagram of the room (attached), she said the cots were located at point A, chair B at point C, and the cots in Madeleine’s bedroom were placed horizontally, not vertically.

When asked, she said that the cleaning, which was provided by the resort, took place on Monday and Wednesday. Thus she mentions once more that she never altered the above described disposition, which means it is not true that at any one moment in time a cot was in the deponent’s bedroom and the other one in MADELEINE’S bedroom.

She asserts that after the day they arrived, April 28, this was the layout of the furniture and this was not altered during the following days.

When asked if she ever slept in Madeleine’s bedroom, she says that such happened on the Wednesday, because she was annoyed with Gerry. He ignored her after dinner when they went to the Tapas bar, which only happened that day. She decided to retaliate by sleeping in the other bedroom, in the bed under the window. She doesn’t know if Gerry noticed this because he was sleeping when she left, and if in fact her husband was aware of this, he made no comment.

Regarding this night she said that none of the children cried, which she would have noticed as she was in the room. Regarding the fact that on the next morning, Thursday, during breakfast, Madeleine said to both of them that she had been crying and that nobody had come to her room, she presumes that this crying must have been before she and Gerry returned to the apartment. When she asked Madeleine about this however, the child gave no importance to the matter. On that night they also checked on the children every half hour; however she thinks that 45 minutes had gone by from the time of the last check to when they arrived, as exceptionally they went to the Tapas’ bar. On this day she thinks that Gerry arrived at the apartment around 23:50 and she arrived 5 minutes later. She went to sleep in Madeleine’s room 15/20 minutes later. Before this she spent a few minutes in her bed next to Gerry.

From reading her previous statement, mainly lines 34-40 it can be understood that on the Wednesday night she slept in the couple’s bedroom, but that did not happen since she slept in Madeleine’s room.

When asked if Madeleine slept in their room, she says yes, as mentioned, on the Tuesday night.

When asked about the sleeping schedule for her children, she says that in England Madeleine slept in a room by herself and the twins slept in another room. At home the twins go to bed between 7 and 7.30 p.m., Madeleine half an hour later. During the holidays, namely in Portugal, the three children went to bed at 7:30 p.m. When asked, she says that during the holidays it is relatively easy to put the three children to sleep because they had not slept during the day and were tired after the day’s activities. When on holiday the twins and Madeleine normally went to sleep at the same time. They never left the apartment for dinner unless the three were actually asleep. Normally when they left the apartment the three children had been asleep for around 1 hour. With the exception of what has been described above, during the holidays, she does not remember any of the children awakening during the night. However, in England, Madeleine sometimes woke up during the night, later, at around 2 – 2:30 a.m., and went to her parents. During the holidays it was normal for the children to awake at around 7:30/8:00 a.m., while in England, at home, they would normally wake up between 7 and 7:30 a.m.

When questioned about a British custom of having a behaviour chart for the children, she says that she has several notes about Madeleine because she would get up during the night with some regularity. This situation dates back to April 2006 up to Christmas time of that same year, when she stopped having this problem. These notes correspond to the stars given on the nights that Madeleine did not get up and go to her parents’ bedroom. When she had 20 stars she got a present and if she woke up at night and did not stay in her bed, she did not get a star.

When questioned, she said that during these holidays Madeleine usually slept clutching a soft toy, a pink cat, and sometimes also wrapped in a pink blanket. Sometimes she slept on top of the bedcover and at other times she was covered with it. When shown a photo of Madeleine’s bedroom and bed, she recognizes the soft toy and the blanket of the same colour.

The interview was interrupted at 5 p.m. for a rest period, and recommenced at 5:15 p.m.

On the 3rd of May they all woke up between 7.30 and 8.00 a.m.; she doesn’t know who woke up first. They washed the children and had breakfast at the apartment between 08:00 and 08:30 a.m. Food was bought by her and GERRY at the “Baptista” supermarket. She refers that the stay included breakfast at the Milénio restaurant, but as it was too far away they’d decided to have breakfast at the apartment. During breakfast the “crying episode”, already described, took place. She noticed a stain, supposedly of tea, on Madeleine’s pyjama top, which she washed a little later that same morning. She hung it out to dry on a small stand, and it was dry by the afternoon. Madeleine sometimes drank tea; nevertheless the stain did not appear during breakfast, maybe it happened another day, as Madeleine did not have tea the previous night and the stain was dry.

After breakfast they got dressed and left the apartment through the main door. All children went walking. The balcony door was closed and locked; she doesn’t know whether the main door was locked or unlocked.

After leaving the apartment they left the twins at the crèche next to the Tapas; at the same time she supposes that Gerry took Madeleine to the crèche next to the 24-hour reception area.

Once the children were delivered, they went to the tennis courts for a scheduled tennis lesson. Kate’s group lesson was at 9:15, Gerry’s an hour later. She doesn’t know what Gerry did during that free hour; she presumes he went to the apartment. When her lesson ended at 10:15, she went to the recreation area next to the swimming pool to talk to Russell until Gerry’s lesson was over. Afterwards, she is not sure, they went back together to the apartment until close to 12:15 when she went to Madeleine’s crèche to pick her up, together with Fiona Payne. She signed the crèche's register and went to the twins’ crèche with the intention of picking them up, she thinks that she met Gerry there, not knowing if he already had the twins with him. Together with the three children they went to the apartment for lunch, with food bought at the supermarket. This would be around 12:35/12:40. They ate sandwiches, mainly the deponent and Gerry, and the children maybe ate pasta. Lunch lasted around 20 minutes. After finishing lunch they stayed for a while at the apartment, then they went to the recreation area next to the pool, as the children were somewhat restless, maybe tired and bored. They remained at this area for about an hour, maybe more, then they left the twins at the crèche next to the Tapas and both of them took Madeleine to the other crèche. They went via a path in front of the small reception and then through a garden area and stairs, taking a short cut. This route was indicated to her by Gerry.

After leaving Madeleine at around 2:50 p.m., they both had, once more, a tennis lesson, this time an individual one just for the two of them, so they started playing a few balls at that time, given the fact that the court was empty.

She doesn’t remember if they were already wearing appropriate clothes or if they went to the apartment to change.

The lesson ended an hour later, at around 4:30 p.m. Gerry continued playing tennis with a guest called JULIAN who belonged to his tennis group, while she went for a jog along the beach, for around half an hour. During that period she saw the rest of the group, children and grownups; she was disappointed as nobody had told her that they were going to the beach and Madeleine surely would have loved to have gone with them. She cannot confirm whether she went to the apartment between the tennis game and the jog.

When she finished jogging, at around 5:20/5:30 p.m., she went to the Tapas area. Gerry was there, as well as the twins and Madeleine who were having dinner at separate tables. Madeleine had been taken to the area by the nannies. Her parents were required to sign the register when the meal was over, at around 5.30 p.m.. During the meal Kate asked Madeleine if she was sad because the other children in the group had gone to the beach without her; she replied that she wasn’t, but was rather tired. She asked Kate to carry her back to the apartment. Kate agreed, and Gerry led the twins back to the apartment, as well. Tiredness was due to the intense daily activities, not to any sickness.

They arrived at the apartment at around 5:40 p.m., earlier than usual, because Madeleine was tired, their other friends were at the beach and Gerry had an all-male tennis game at 6:00 p.m. At the apartment they both bathed the children, and close to 6:00 p.m. Gerry went to the tennis courts, right after the children had finished their bath. They entered the apartment by the main door, with the key. She does not know if it was locked, and presumes it was Gerry who opened it. At lunch time they also entered through the same door.

After the children’s bath, already alone, she put pyjamas and nappies on the twins, and gave them each a glass of milk and biscuits. Before bathing the children and because it was early, they had thought of taking them to the recreation area, but then decided against this because of tiredness.

While the children were eating and looking at some books, Kate had a shower which lasted around 5 minutes. After showering, at around 6:30/6:40 p.m. and while she was getting dry, she heard somebody knocking at the balcony door. She wrapped herself in a towel and went to see who was at the balcony door. This door was closed but not locked as Gerry had left through this door. She saw that it was David Payne, because he called out and had opened the door slightly. David’s visit was to help her to take the children to the recreation area. When David returned from the beach he was with Gerry at the tennis courts, and it was Gerry who asked him to help Kate with taking the children to the recreation area, which had been arranged but did not take place. David was at the apartment for around 30 seconds, he didn’t even actually enter the flat, he remained at the balcony door. According to her he then left for the tennis courts where Gerry was. The time was around 6:30-6:40 p.m.

After David left, Kate dressed and sat with the children, Madeleine on her lap. She was wearing a top, she doesn’t remember what colour it was, a green long-sleeved t-shirt, blue denim trousers. Sports shoes and white socks.

She read a story to the children in the living room, on the sofa in front of the balcony door, identified on the diagram with the letter D. At 7:00 p.m. Gerry arrived and entered through the balcony door. He sat on the sofa identified with letter E. She doesn’t know if the story was finished, but thinks she was still sitting on the sofa.

She doesn’t remember having changed the layout of the furniture in the living room, the sofas, the table or others. She says that the sofa (letter E) supposedly was against the side window, because she doesn’t remember anyone having gone behind it. She does not know if this window was open or closed, she does not remember it ever being open, or looking through the window.

After Gerry arrived the children went to wash their teeth and she then read them another story, this time all four of them sitting on Madeleine’s bed. She thinks that Gerry entered the room, but does not recall him sitting on the bed. During the story Madeleine was lying on the pillow, but alert and paying attention to the story. Afterwards both twins kissed Madeleine, she thinks that Gerry was in the room, and each one of them, the deponent and Gerry, placed a twin in its cot at the same time, between Madeleine’s bed and the bed under the window. They also kissed Madeleine, who was already lying down. She was under the covers, she thinks, because it was a bit cold. She normally clutched the soft toy and if she wasn’t holding it then it was next to her, on the left. She remained lying down on her left side, with the soft toy and a pink blanket, which she thinks was covering her. The twins were laid down on their backs, covered with open weave blankets. She says that she doesn’t know if the children were in the same positions when they left the apartment.

It was around 7:15 p.m. when they put the children to bed and checked they were sleeping, she is sure of this.

As the children were asleep, she dried her hair and put on make up. Gerry maybe had a shower and they sat on one of the sofas in the living room, she doesn’t know which one. She had a glass of wine, poured by Gerry, and he had wine or beer. The wine was from New Zealand, white.

Gerry was wearing blue denim trousers and sports shoes. She doesn’t remember what else he was wearing.

They talked while they drank, until they left for the Tapas restaurant at around 8.30-8.35 p.m. Before leaving they checked on the children, she doesn’t know who; however Gerry says it was him. She only knows the children were quiet. She doesn’t know if they were in their same positions. She says she is sure that they were asleep, because Gerry told her so and all was quiet.

They left through the balcony door, which they left closed but not locked. Main door was closed but not locked. She thinks it could be opened from the inside but not from the outside. She thinks that before she left she put on a cream coloured polar fleece with a zipper, and on top a blue raincoat, also with a zipper. Concerning Gerry, she doesn’t know if he put on any other clothing items.

Concerning objects, she says they took their mobile phones with them, and Gerry might also have taken his wallet with money. Not sure if they took a camera.

Regarding the apartment, and as far as windows are concerned, she said they were closed but she doesn’t know if they were locked. The balcony window was closed but not locked, curtains closed. The second window in the living room was probably closed, she never used it and does not know if the shutters were closed. The kitchen window was probably closed but with the shutters open as there was light in the kitchen.

The window to Madeleine’s bedroom remained closed, but she doesn’t know if it was locked, shutters and curtains drawn, and that was how it remained since the first day, night and day. She never opened it. If somebody saw the window shutters in Madeleine’s room open, it was not the deponent who opened them, and she never saw them open.

The window in the deponent’s bedroom was closed and she knows they use the shutters, even because Gerry broke them and they were repaired on the Monday; the incident would have taken place on Sunday.

When asked, she said that before they left she took some precautions, namely placed the medicine inside a bag with a clasp in her room inside the wardrobe or the dresser. These were Calpol (paracetamol) and Nurofen (ibuprofen), for fevers and pains, both for adults and children (packages in liquid for the children). In this bag there was also a small pair of scissors. In the kitchen were cutting items that were used to prepare the meals and which were not put out of sight. During their trips it was normal for them to take these medicines. During these holidays she never gave any medicine to her children, nor did Gerry. She now says that Gerry also took medicine for acidity called Losec (omeprozole) which they also possessed.

The interview was interrupted at around 8 p.m. for a brief rest period and food; it was recommenced at 10:00 p.m.

Back to the description, the deponent says that on the 3rd they left the apartment leaving the children sleeping. Knowing that Madeleine sometimes woke and got up, she did not worry about leaving her alone, because when this happened, and it wasn’t always, it was around 2 – 3 a.m., at which time they would be back in the apartment already.

They left the apartment between 8:30-8:35 p.m., and headed straight for the Tapas where they arrived 1 minute later maximum. None of the group were at the Tapas because they were usually the first to arrive, but she isn’t sure this was the case every night. There was a couple there who they knew, Steve and Carolyn Carpenter, who belonged to Gerry’s tennis group. They talked with them for a few moments before sitting down. Meanwhile, while they talked to the Carpenters, the rest of their group arrived and sat down at a round table, where they sat every day. Order of arrival: Kate and Gerry first, then Jane, she thinks on her own, then Mathew and Rachel, then Russell, she thinks, and right afterwards David, Fiona and Diane. She makes a sketch of the table and says that both she and Gerry were not facing the apartments. Sketch attached.

Dinner began around 9 p.m., and she thinks the nine adults were at the table. She ate steak and maybe sardines. She drank white wine and water.

She doesn’t know if anyone took any photographs that night, however she thinks that Rachel took photos on one of the nights. When asked, she said that Fiona also took some photos but she thinks it was probably on another night. She doesn’t know whether Fiona had a camera with her that night. She remembers hearing a comment that night about a camera being forgotten, but she doesn’t know who said this or who the camera belonged to.

Concerning the checks on the children, she said that Gerry was the first one to check on the children, this was decided on the spot, at around 9-9:05 p.m. He got up from the table and entered the apartment through the balcony door. He came back to the table ten minutes later; he implied that the children were asleep and that he’d met a tennis friend by the name of Jez, with whom he had a chat. During this check, she thinks that Gerry did not check on the children of any other couple, because it was usual just to check on their own children. She never checked on any other child, other than her own.

At 9:30 p.m. she got up to go and check on her children at the same time as Mathew, who said he was going to check on his daughter Grace in apartment 5B, and could check on her children. She hesitated, however he said not to worry as he was going anyway.

After less than ten minutes Mathew returned to the Tapas, saying all was quiet. At that time she did not ask him if he went inside the apartment, however she assumed he had checked on her children, entering through the balcony door which was closed but not locked.

Apart from Matt, she does not remember if anyone else got up from the table.

At 10 p.m. she got up from the table, as it was her turn after having been replaced by Matt. She entered the apartment by the balcony door which was closed, but as already said, not locked.

At this moment, and because it is late, 11 p.m., the interview was interrupted and will be continued on the next morning.

She says nothing further. Reads, confirms, ratifies and signs, as do the interpreter and the defence lawyer.

Que sendo de nacionalidade britanica desconhece a linga portuguesa, na sua forma oral e escrita, pelo que se encontra presente uma interprete indicada pela assistente da lista fornecida pelo Consulado, Axx Dxx Sxx Rxx, contactavel atraves do telefone xxxx.
Neste acto encontra-se tambem presente o Mandatario Constituido, cuja procuracao ja se fez juncao aos autos, Dr Carlos Pinto de Abreu, CP no 9786L.
Que confirma na integra o teor das suas declaracoes prestadas nesta Policia, no dia 04 de Maio de 2007, dia seguinte aos factos em investigacao.
Perguntada relitavemente ao dia 01 de Maio de 2007, feriado, disse que neste dia sairam do apartamento cerca das 20H30, alias horario que repetiam todas as noites. No restaurante estava marcada essa hora como inicio da refeicao, exceptuando o sabado, dia de chegada que jantaram no restaurante Milenio. Nesse dia, 01 de Maio, as criancas ficaram a dormer, ja que as deitou pelas 19H15/19H30, nao tendo duvidas que estavam a dormer.
Chegaram ao TAPAS, pelas 20H31, uma vez que fizeram o trajecto directo, ou seja sairam pela porta da varanda, desceram a rua e entraram na recepcao secundaria do empreendimento.
Como sairam pela porta da varanda, esta ficou fechada mas nao trancada, uma vez que tal so e possivel pelo interior. Fechou os cortinados.
Quando chegaram ao Tapas, pensa que nao se encontrava ninguem do grupo, mas nao pode assegurar.
Perguntada disse que no decurso do jantar, de meia em meia hora vinham ao apartamento ver os filhos. Este acto era asseguardo pela depoente e pelo GERRY. Nao se recorda se nesta noite algum dos amigos foi ao apartamento. Disse que o RUSSEL nao esteve presente no jantar, pelo que a esposa desse JANE ou alguem lhe levou a refeicao ao apartamento. O motivo da ausencia prendeu-se com uma enfermidade da filha mais nova do casal..
Indagada disse que o jantar terminou pelas 23H00, tendo, juntamente com o GERRY, ido para o apartamento.
Sendo de meia em meia hora, pensa que foram ao apartamento quatro vezes, duas a depoente o duas o seu marido, pelas 21H00-21H30-22H00 e 22H30 aproximadamente.
Perguntada pelo facto da sua filha ter estado a chorar na noite de terca feira durante uma hora e quinze minutes, entre as 22H30 e as 23H45, disse nao corresponder a verdade. Quanto a este tema refere que a MADELEINE, nessa noite apos as 24H00 se dirigiu ao seu quarto disse que a irma. AMELIE, estava a chorar, e como tal ficou a dormer consigo e com o GERRY no quarto de ambes. Adianta que antes da MADELEINE surgir no se quarto, ja tinha ouvide a AMELIE chorar, no entanto nao foi ao quarto, pois a MADELEINE foi ao quarto quase em simultaneo com a percepcao do choro. Nao se recorda se posteriormente foi ao quarto das criancas, ou o GERRY, no entanto assegurar que a AMELIE chorou durante pouco tempo.
Indagada disse que nesta noite os gemeos dormiram no quarto, onde dormia a MADELEINE, cada um no seu berco.
Perguntada quanto a disposicao do apartamento, disse que no primeiro dia alteraram a disposicao dos movels, ou seja, tiraram os dois bercos do seu quarto e colocaram-nos no outro, onde passaram a dormer as criancas apos afasterem as duas camas de corpo e meio ai colocadas. Tambem juntaram as duas camas de solteiro que estavam no seu quarto. Presume que os bercos, quando estavam colocados no seu quarto, ficaram aos pes das camas.
Alias refere que quando chegou estavam nao dois tres bercos, no mesmo sitio, tendo, segundo penso, cedido um a familia PAYNE.
Ao lhe ser exibido o croqui da habitacao, o qual se junta, disse que os bercos estavam no local assinalado pela letra A, a cadeira B no local C, e os bercos ja no quarto da MADELEINE dispostos nao na vertical, mas sim na horizontal.
Perguntada disse que os dias de limpeza assegurada pelo empreendimento, foram na 2 feira e 4 feira. Deste modo refere mais uma vez que nunca alterou a disposicao atras descrita, o que significa nao ser verdade que estivesse em algum momento um berco no quarto da depoente a outro no quarto da MADELEINE.
Assevera assim que apos o dia de chegada, 28 de Abril, foi esta a disposicao, nada alterando nos dia subsequentes.
Perguntada se alguma vez dormiu no quarto da MADELEINE disse que tal sucedeu na quarta-feira, por se ter zangado com o GERRY. Que aquele a ignorou apos a jantar, quando foram para o bar do TAPAS, o que so sucedeu neste dia, e como tal decidiu retaliar, dormindo noutro quarto, na cama junto a janela. Nao sabe se o GERRY se apercebeu que a depoente dormiu noutro quarto, ja que aquele dormia quando ela se ausentou e se de facto o seu marido foi consciente desta situacao nao o comentou.
Ainda nesta noite disse que nenhuma das criancas chorou, senao ter-se-la apercebido, ja que se encontrava na habitacao. Quanto ao facio da MADELEINE na manha do dia seguinte, 5 feira, durante o pequeno almoco ter ditto para ambos, que tinha estado a chorar e que ninguem havia ido ao quarto, presume que o choro tera sido antes da depoente e o GERRY terem regressado a casa. Ainda questinou a MADELEINE sobre esta questao, no entanto aquele nao ligou ao assunto. Tambem nesta noite fizeram as verificacoes aos filhos de meia em meia hora, no entanto pensa que desde a ultima verificacao ate a chegada terao passado 45 minutos, ja que foram, excepcionalamente, ao bar do TAPAS. Neste dia pensa que o GERRY chegou ao apartamento pelas 23H50 e a depoente cinco minutos depois, tendo ido dormir para o quarto da MADELEINE 15/20 minutos depois. Ainda antes disso esteve alguns minutos na sua cama ao lado do GERRY.
Da leitura do seu anterior depoimento, nomeadamente do constante a linhas 34 a 40 pode-se entender que na noite de quarta para quinta feira a depoente tera dormindo no quarto de casal, porem isso nao sucedeu uma vez que dormiu sim no quarto da MADELEINE.
Questionada se a MADELEINE alguma vez dormiu no quarto ocupado pela depoente e pelo marido afirmou que sim, conforme atras referido designadamente na terca feira.
Questionada quanto aos horarios a que habitualmente deitava os seus filhos referiu que na casa que habitem em Inglaterra a MADELEINE dormia num quarto so para si, enquanto os gemeos ocupavam outro quarto. Quando em casa os gemeos vao para a cama entre as 19H00 e as 19H30, enquanto que a MADELEINE se deitava meia hora depois. Durante as ferias e nomeadamente em Portugal os seus tres filhos iam para a cama ate as 19H30. Perguntado refere que no periodo de ferias era relativamente facil colocar os tres filhos a dormir uma vez que nao dormiam durante of dia e estavam cansados das actividades diarias. Ainda durante as ferias refere que normalmente os tres, gemeos e MADELEINE, adormeciam ao mesmo tempo. Nunca sairam de casa para jantar sem que os tres estivessem efectivamente a dormir. Normalmente quando saiam de casa ja os tres estavam a dormir ha cerca de 1 hora. Come excepcao da situacao atras descrita, durante as ferias, nao se recorda de qualquer das criancas ter acordado durante a noite. No entanto em Inglaterra, a MADELEINE por vezes acordava durante a noite, mais tarde pelas 02H00-02H30, e ia ter com os pais. Durante o period de ferias era normal que as criancas acordassem pelas 07H30/08H00, ja em Inglaterra em casa, isso acontece normalmente entre as 07H00 e as 07H30.
Indagada relativamente a um costume britanico de assinalar o comportamento dos filhos num quadro disse que possui uma serie de anotacoes sobre a MADELEINE atinentes ao facto de com alguma regularidade se levanter durante a noite. Esta situacao reporta-se a Abril de 2006 ate a periodo natalicio do mesmo ano, momento a partir do qual a MADELEINE deixou de ter este problema. Estas anotacoes correspondiam a estrelas respeitantes a noites em que a MADELEINE nao se levantava e ia ao quarto dos pais. Quando atingia 20 estrelas era presenteada e caso acordasse pela noite e nao ficasse na sua cama, era retardada a atribuicao dessa estela.
Indagada, aquando desta ferias, disse que a MADELEINE normalmente dormia agarrada a um peluche, um gato cor de rosa, e por vezes embrulhada numa manta tambem da mesma cor. Em determinadas ocasioes dormia por cima da colcha e outras coberta com essa. Ao lhe ser exibido uma fotografia do quarto da MADELEINE e respective cama, reconhece o peluche, bem como a manta da mesma cor.
Pelas 17H00 foi interrompido o auto para descanso, tendo sido retomado as 17H15.
No atinentes ao dia 03 de Maio, disse que accordaram todos entre as 0730/08H00, nao sabendo escpecificar quem acordou primeiro. Ao despertarem fizeram a hygiene as criancas, e tomaram o pequeno almoco no apartamento entre as 08H00/08H30. a comida era comprada pela depoente e GERRY no supermercado “Baptista”. Refere que a estadia previa o pequeno almoco no restaurante Milenio, mas como era demasiado longe, optaram por fazer a refeicao no apartamento. Durante o pequeno almoco passou-se o episodio da alusao ao choro, ja descrito, bem como reparou numa, supostamente de cha na parte superior do pijama da MADELEINE, o que foi lavado pela depoente, nessa manha, masum pouco mais tarde. Estende num pequeno estendal, tendo secado ate essa tarde. Ocasionalmente a MADELEINE bebia cha, n entanto o aparecimento dessa manch nao tera sido durante o pequeno almoco, talvez num outro, ja que afirma que ela nao bebeu esse liquido na noite anterior e a mesma estava seca.
Terminado o pequeno almoco vestiram-se do apartamento pela porta de entrada principal. Todas as criancas pelo proprio pe. A porta da varanda ficou fechada e trancada, e a porta principal nao sabe se ficou no trinco ou com os fechos activos.
Apos sairam do apartamento deixaram os gemeos na crèche junto ao Tapas ao mesmo tempo que o GERRY, ao que presume levou a MADELEINE para a crèche junto a recepcao de 24 horas.
Entregues as criancas foram para os courts de tenis, onde tinham uma aula ja agendada. A aula do grupo da depoente era as 09H15 e do GERRY era uma hora depois. Nao sabe o que o GERRY fez nessa hora livre, mas presume que tera ido para o apartamento. Terminada a aula pelas 10H15, a depoente manteve-se junto a uma area de recreio, perto da piscine a converser com o RUSSEL, ate, ao que julga, terminar a aula do seu marido. Em seguida, nao tendo a certeza regressaram juntos ao apartamento, ate cerca das 12H15, altura em que se dirigiu a crèche da MADELEINE, para a recolher, acompanhada da FYONA PAYNE. Assinou o registo de entrega da criancas e dirigiu-se para a crèche dos gemeos com o intuito de os recolher, onde pensa ter encontrado o GERRY, nao sabendo tambem se ele ja tinha os gemeos consigo. Ja com as tres criancas form para apartamento a fim de almocarem, mais uma vez com a comida adquirida no supermercado. Seriam 12H35/12H40. comeram sandes, principalmente a depoente e o GERRY, e as criancas talvez massas. O almoco durou cerca de 20 minutos. Aos o terminus da refeicao mantiveram-se algum tempo no apartamento e depois foram todos para a area de recreio junto a piscine, ja que as criancas estavam algo irrequietas, talves cansadas e aborrecidas. Estiveram nesse local cerca de uma 1 hora ou pouco mais tendo entao deixado os gemeos junto a crèche do Tapas e ambos levaram a MADELEINE a outra crèche. O trajecto era feito por um caminho defronte da recepcao pequeno, e depois por uma zona ajardinada e escadas, que permitia crier um atalho. Este caminho foi-lhe indicado pelo GERRY.
Depois de deixaram a MADELEINE, aproximadamente pelas 14H50, os dois tinham, mais uma vez, uma licao de tenis, desta feita individual, so para os dois, pelo que comecaram a bater umas bolas ate essa hora, ja que o campo estava desocupado.
Nao se recorda se estavam ja com a indumentaria correcta para esse treino, ou se foram ao apartamento equiparem-se.
A aula terminou uma hora depois, cerca das 16H30, tendo o GERRY continuado a jogar tenis com um hospede de nome JxxxxN, que ja pertencia ao grupo de jogo do seu marido, enquanto a depoente foi fazer uma corrida na praia, durante cerca de meia hora. Nesse hiato temporal viu os restante elementos do seu grupo, adultos e criancas, tendo ate ficado desapontada, pois nao lhe foi dito que iam para a praia e seguramente a MADELEINE iria gostar de os acompanhar. Entre o jogo de tenis e a corrida, nao pode afirmar talvez tenha ido ao apartamento.
Apos finalizar a corrida, cerca das 17H20/17H30 foi para a area do Tapas, onde se encontrava o GERRY, com os seus dois filhos gemeos e a MADELEINE, os quais estavam a jantar, ainda que em mesas diferentes. A MADELEINE foi levada para esse local pelas educadoras do resort, tendo os pais a obrigacao de assinar o registo de entraga das criancas no final da refeicao, que terminou pelas 17H30, tendo assim chegado no final do jantar. Durante o jantar a depoente perguntou a MADELEINE se estava triste, ja que as outras criancas do grupo tinham ido para a praia sem ela, ao que essa respondeu negativamente, assegurando estar sim cansada. Pediu entao a depoente que a levasse ao colo para o apartamento, ao que anuiu, tendo o GERRY levado os gemeos pela mao, tambem para casa. Esse cansaco era proprio da actividades diaria intense nao em resultado de doenca.
Ao apartamento chegaram pelas 17H40, mais cedo do que habitual, uma vez que a MADELEINE estava cansada, os restantes amigos estavam na praia e o GERRY tinha um jogo de tenis exclusivamente masculino as 18H00. No apartamento deram banho as criancas, ainda os dois, e perto das 18H00 o GERRY foi para os campos de tenis, logo apos a saida do banho por parte das criancas. A entrada no apartamento fez-se pela porta principal, com recurso a chave, nao sabendo se estava trancada, presumindo que foi o GERRY quem a abriu. Ao almoco tambem entraram pela mesma porta.
Apos o banho das criancas ja sozinha, vestiu os pijamas e colocou nos fraldas nos gemeos, deulhes um copo de leite e bolachas, a cada um deles. Ainda antes dos banhos, pensaram lever as criancas, desta feita depois do banho porque ainda era cedo, a area de recreio, no entanto desistiram da ideia pelo cansaco.
Enquanto as criancas comiam e viam uns livros a depoente aproveitou para tomar duche, o que durou cerca de 5 minutos. Terminada a higiene, pelas 18H30/18H40, e quando ainda se secava ouviu alguem bater a porta da varanda. Embrulhou-se numa toalha e foi ver quem era a porta da varanda. Que estaria fechada mas nao trancada ja que o GERRY tera por ali saido. Verificou que era o DAVID PAYNE, ate porque esse a chamou a tera aberto ligeiramente a dita porta. A visita do DAVID foi para ajudar a depoente a lever as criancas para a area de recreio. Quando o DAVID regressou da praia esteve com o GERRY, nos campos de tenis, o qual lhe disse para ir ajudar a depoente com os filhos no transporte para a zona de recreio, o que estava previsto, mas nao foi executado. O DAVID esteve no apartamento cerca de 30 segundos, nem chegou efectivamente a entrar na casa, ficou pela porta da varanda. Esta dirigiu-se entao, segundo ele, para os campos de tenis onde se encontrava o GERRY. Seriam ainda 18H30-18H40.
Apos a saida do DAVID a depoente vestiu-se e sentou-se com as criancas, a MADELEINE ao colo. Vestiu um top, cuja cor que nao se recorda e uma t-shirt de manga compride de cor verde. Calcas de ganga de cor azul. Sapatos desportivos e peugas de cor branca.
Leu uma historia as criancas na sala de estar, no sofa defronte da porta da varanda, assinalado no croqui com a letra D, momento em que entra o GERRY, as 19H00, pela porta da varanda, ao que julga, sentando-se no sofa assinalado com e letra E. Nao sabe se ainda lia a historia mas pensa que ainda estava sentada no sofa.
Perguntado disse que nao se recorda de ter alterado a disposicao do mobilaria da sala de estar, quer os sofas, quer a mesa ou outros. Disse que o sofa (letra E) supostamente estaria encostado a janela lateral, pois nao se recorda de alguem ter passado pela retaguarda. Nao sabe se esta janela estava aberta ou fechada, nem se recorda de alguma vez a ter aberto, ou espreitado por esse local.
Depois da entrada do GERRY as criancas foram lavar os dentes e em seguida leu-lhes outra historia infantile, desta feita os quatro sentados na cama da MADELEINE. Pensa que o GERRY entrou no quarto, mas nao se lembra dele se ter sentado na cama. Durante a historia a MADELEINE deitou-se sob a almofada, mas estava alerta, pois prestou atencao a historia. Logo apos os gemeos beijaram a MADELEINE, ao que julga com o GERRY no quarto, e cada um, depoente e GERRY colocaram-nos nos bercos, em simultaneo, entre a cama da MADELEINE a cama junto a janela beijaram tambem a MADELEINE, ja com esta deitada. Ela estava debaixo do cobertores, ao que julga, porque estava algum frio. Ficava normalmente agarrada ao peluche e se nao estava agarrada estava proximo, do lado esquerdo. Ficou deitada sobre o lado esquerdo, com peluche e com uma manta cor de rosa, que pensa estaria a cobri-la, os gemeos ficaram deitados de barriga para cima, cobertos com mantas de orificios. Refere que antes de sairam do apartamento nao sabe se as criancas estavam nas mesmas posicoes.
Seriam 19H15 quando deitaram as criancas e verificarm que adormeceram, esta segura disso.
Com as criancas a dormirem a depoente secou o cabelo maquilhhou-se. O GERRY talvez tomado um duche e sentaram-se num dos sofas na sala de estar, nao sabe qual. A depoente bebeu um copo de vinho, servido pelo GERRY, e este vinho ou cerveja. Seria vinho noezelandes branco.
O GERRY vestiu calcas de ganga de cor azul e sapatos desportivos. Nao se recorda da restante indumentaria.
Conversaram durante a bebida, ate cerca das 20H30-20H35, altura em que se dirigiram para o restaurante TAPAS. Antes de sairam foram ver as criancas, nao sabe quem, mas o GERRY disse ter sido ele, so sabendo que estavam em silencio. Nao sabe se estavam nas mesma posicoes. Disse que tem a certeza que estavam a dormir, porque o GERRY lhe disse e estava tudo em silencio.
A saida processou-se pela porta da varanda que deixaram fechada mas nao trancada. A porta principal estava fechada mas nao com a chave. Pensa que se podia abrir pelo interior mas nao por fora. Refere que ainda antes de sair, ao que julga, vestiu um polar de fecho de corer de cor crème e por cima um impermeavel de cor azul e tambem com fecho de corre. Quanto ao GERRY nao sabe se vestiu outra pecas de roupa.
No tocante a objectos disse ter levado, cada um, os telemoveis e o GERRY podera ter tambem levado a carteira come dinheiro. Nao tem a certeza se levaram ou nao qualquer maquina fotografica.
Quanto ao apartamento e no que diz respeito a janelas, disse que ficaram fechadas mas nao sabe se trancadas. A da varanda ficou fechada, mas nao trancada e com s cortinados corridos. A segunda janela da sala pensa que estaria fechada nunca a manuscou e nao sabe se os estores estavam fechadas. A janela da cozinha, pensa que estaria fechada mas com os estores abertos ja que havia luz na cozinha.
A janela do quarto da MADELEINE ficou fechada, mas nao sabe se trancada, estores e cortinados corridos, e assim ficou desde o primeiro dia, pela noite e dia. Nunca a abriu. Que se alguem viu os estores da janela do quarto da MADELEINE abertos, nao foi a depoente que os abriu, nem nunca s viu abertos.
A janela do quarto da depoente estava fechada e sabe que utilizam os estores, ate porque o GERRY os partiu em determinadas ocasiao, os quais foram reparados na 2 feira, pelo que o incidente tera ocorrido no Domingo.
Perguntado disse que antes de sairem tomou alguns cuidados, nomeadamente colocou a medicacao numa bolsa com um fecho, no seu quarto, dentro do guarda fatos ou na comoda. Tratava-se de medicamentos com o nome “Calpol” (paracetamol) e Nurofen (ibuprofen), antipireticos e analgesicos, para estados febris e dores, em doses de adulto e criancas (saquetas em liquido para as criancas). Nesta bolsa tambem se encontrava uma pequeno tesoura. Na cozinha estariam objectos corantes, que utilizou nas refeicoes e que de facto nao os escondeu. Durante as viagens e normal levaram estes medicamentos. Nestas ferias nunca deu qualquer medicacao aos seus filhos, nem o GERRY o faz. Refere agora que o GERRY tambem usava um medicamento para a acidez estomacal de nome “Losec” (omeprozole) e que tambem possuiam.
Pelas 20H00 foi interrompido o presente auto, para breve descanso e alimentacao, o qual foi retomado as 22H00.
Volvendo a descricao, disse que no dia 03, sairam do apartamento deixando os filhos a dormir. Sabendo que a MADELEINE por vezes acordava e se levantava, nao se preocupou em a deixar sozinha, porque quando isso sucedia, o que nao era sempre, era por volta das 02H00-03H00, altura em que ja estavam de regresso ao apartamento.
Saindo do apartamento, conforme detras dito, entre as 20H30-20H35, foram directos para o Tapas, onde chegaram no maximo um minuto depois. Do grupo nao se encontrava ninguem no Tapas, ate porque normalmente eram os primeiros a chegar, todavia nao o pode assegurar em todas as noites. Nao sendo do grupo encontrava-se um casal conhecido de nome S e C xxx, que pertenciam ao grupo de tenis do GERRY. Falaram com eles, ainda antes de se sentaram, durante breves instantes. Entranto, enquanto falavam com os xxx, foram chegando elementos do seu grupo, que se sentaram numa mesa de forma redonda, na qual se sentavam todos os dias. A ordem de chegada foi primeiro a depoente e o GERRY, depois a JANE, ao que julga sozinha, depois o MATTHEW e a RACHEL, e em seguida o RUSSEL, ao que julga e logo apos DAVID, FIONA e DIANE. Pelo seu proprio punho dispos os elementos no grupo, dizendo que tanto a depoente como o seu marido nao ficaram de frente para os apartamentos. Junta-se o croqui.
Seriam cerca 21H00 quando iniciaram a refeicao, com os nove adultos na mesa, ao que julga. Comeu bife, e talvez sardinhas. Bebeu vinho branco e agua.
Nao sabe se alguem nessa noite tirou fotografias, no entanto pensa que RACHEL efectuou fotografias numa das noites. Perguntado disse que a FIONA tambem tirou fotografias, mas pensa ter sido numa outra noite. Nao sabe se a FIONA tinha alguma maquina fotografica naquela noite. Lembra-se de ouvir um comentario naquela noite sobre um esquecimento de uma maquina fotografica, no entanto nao sabe a sua proveniencia ou a quem pertencia.
No tocante a verificacao dos filhos, disse que o primeiro a ir ver as criancas foi o GERRY, por decisao no local, cerca das 21H00-21H05. Ele levantou-se da mesa e entrou no apartamento pela porta da varanda. Regressou a mesa passados dez minutos, este insinuou que as criancas estavam a dormir e que tinha encontrado um amigo do tenis de nome JEZ, com quem conversara. Durante esta visita o GERRY, ao que julga, na viu os filhos de qualquer outro casal ate porque o normal era cada um visitar os seus filhos. A depoente nunca foi ver qualquer crianca, alem dos seus.
As 21H30 a depoente levantou-se para ir ver os seus filhos, ao mesmo tempo que o MATTHEW, o qual disse que ia ver a sua filha G***e, no apartamento 5B, e deste modo veria os filhos da depoente. Ainda hesitou, no entanto aquele disse para nao se preocupar, pois ia de qualquer modo.
Passados menos de dez minutos o MATTHEW regressou ao Tapas, dizendo estar tudo em silencio. Na altura nao lhe perguntou se ele entrou no apartamento, no entanto assumiu que esse tivesse verificado os filhos, tendo entrada pela porta da varanda, fechada mas nao trancada.
Alem do MATT nao se lembra se mais alguem se levantou da mesa.
Sendo 22H00, a depoente levantou-se da mesa, ja que era a sua vez, pois havia sido substituida pelo MATT, entrou no apartamento pela porta da varanda que estava fechada, mas conforme dito nao trancada.
Neste momento e dado o adiantado da hora, 23H00, foi interrompido o presente auto que sera retomado no dia seguinte pela manha.
E mais nao disse. Lido o auto o achou conforme, ratifica e vai assinar, juntamente com a Interprete e Defensor.
