Witness statement of Gerald Patrick McCann, on the 10th of May 2007, at 3.20 p.m.

The witness is heard as a victim, being the father of the minor. Of British nationality, he has no command of the Portuguese language, spoken or written. Thus, the interview is
done in the presence of an interpreter, Alice Dias Homem de Gouveia Avakoff.

That he fully confirms the statements made previously at this police department on 4 May 2007, being available to provide any further clarifications.

Asked, he clarifies that, apart from the personal photos already delivered by him to the police authorities after the disappearance of his daughter MADELEINE, he has no others in his possession. He adds that it is his wife KATE who usually takes pictures, he does not recall taking any pictures during this holiday, at night.

As he was asked, he mentions that in January 2003 he went to Lanzarote, in Spain, with Fiona and David Payne, where they spent a week's holiday not having any children at that time. At that time, despite having no children yet, KATE was 6 months pregnant with MADELEINE, a pregnancy that resulted from IVF. Still in 2003, in September, he went to Umbria, in Italy, with his wife KATE, and the couples MATHEW and RACHEL, and RUSSEL and JANE, for a week's holiday where they attended FIONA and DAVID's wedding. The deponent clarifies that the trip to Lanzarote was organised by himself as he had been there the previous year with KATE and they had enjoyed it very much, whereas the trip to Italy was arranged by FIONA and DAVID, given that it was for their wedding.

Concerning the events in Portugal, as already stated in his previous statements, he arrived at Faro airport on 28 April 2007 at around 12h30, having travelled immediately to the OCEAN CLUB in an airport mini-bus where he arrived at around 14h20/14h30.

That he headed for the OCEAN CLUB reception where he presented his documents, those of KATE and of his three children, for check-in. He was then given the key to apartment A5, the choice of that apartment having been made at random by the OCEAN CLUB management, given that, as he understood it, David Payne, who had dealt directly with the reservations, had not been given a choice.

He adds that the only stipulation by the group was that the apartments had to be close to one another because, contrary to what the trip brochure announced, the resort did not provide a "baby listening" service, that is, a service in which a group of employees would “watch over” the children that are asleep in their apartments while the parents are away. He doesn't know exactly how that surveillance works in practice, given the fact that he never used it, but he knows that other MARK WARNER resorts provide this service, and some members of his group had access to it on previous holidays, though he does not know exactly who. He mentions that, for this reason, David Payne decided to use the personal listening devices to monitor his children, though he had never used them on previous holidays that they had spent together.

That, on the first day, given that they arrived at lunch time, they ate only sandwiches both on the plane and on the bus during the journey from the airport to the OCEAN CLUB. After completing the check-in at the main reception, where they were dropped off by the mini-bus, which lasted until 15h00, they went to the apartment where they unpacked their bags, which lasted 16h45. Pointing out that after check-in, the trip with the bags to the apartment was made on a mini-bus that belonged to the resort.

Subsequently, at around 17h00, the whole group, including children, went to the TAPAS restaurant, located at the back of the apartment, next to the pool, to attend a welcoming committee arranged by MARK WARNER, where they met the tennis and sailing instructors, and other resort employees, which ended at around 18h30, several glasses of sangria having been served to them.

That that was the first time they all walked together inside and around the resort. They left by the front door, which he locked with the key, he walked around the existing wall and turned right, going down the resort’s side road up to the secondary reception, where they entered without difficulty , although they had an access card, which was not requested from them and that they had been given during Check-in.

After they passed through the secondary reception, they went to the TAPAS restaurant, next to one of the swimming pools, the adults having sat down in a covered area outside, while the children stayed next to the small pool playing on the playground that was there. That during this time all the adults stood up and went to watch the children near where they were. The deponent and his wife took turns watching.

When the reception committee was over, the nine adults and eight children walked to the MILLENIUM restaurant. They went back to the secondary reception, turned left and, at the top of the road, turned right, then left again, then right again, up to the main street that leads to the restaurant. Because it was a long way, at some point in time the deponent and his wife KATE had to carry the twins in their arms, but not MADELEINE, who was always on foot.

They arrived at their destination between 18h50 and 19h00, having sat at a large table where they all had dinner, including the children who were seated among the adults, never leaving the place, except for one of the twins who went to the toilet with the deponent. About an hour later they finished dinner, and returned, equally walking, by the same route, though going wrong in one of the streets where they should have turned left, ending up only turning only at the next street. He adds that, as they were all very tired they went directly to the apartment, where they arrived at around 20h10/20h15, the route back having been slightly faster given that the twins were carried all the way.

In the apartment, they bathed the children and gave them a glass of milk, putting them to bed at exactly 20h45, he remembers that time because it was exactly one hour later than their usual bedtime. After putting the children to bed, the deponent and his wife took a bath, then settled down in the living room to watch television. He points out that at the moment they arrived at the residence, David Payne invited them to go for a glass of wine after putting down the children, but they turned down the offer as they were extremely tired. He thinks that nobody left their apartments on the first night. Asked, he said that in England, when not on holiday, the deponent and his wife would go to bed at 22h30/23h00, the twins at 19h00 and MADELEINE at 19H30.

The following day (Sunday), the children woke up at 08h00, the deponent and his wife having woken up at around 07h30. They got dressed and at about 08h40 they left the apartment going to the MILLENIUM restaurant, once more on foot and by the same route as on the previous night, but without the mistake referred to previously, arriving there at 08h45/09h00. The group did not all arrive at the same time, rather in a phased manner, therefore they were not all seated at the same table.

He thinks that MATHEW and his wife RACHEL did not take breakfast due to the former having spent a bad night with vomiting and diarrhoea. At breakfast the children again sat at the same table among the adults, and it finished at around 09h25.

The deponent, his wife KATE and their three children went to the OCEAN CLUB by the same route, where they arrived at 09h40, the deponent having entered the apartment by the main door, which was locked, collecting a bag with clothing and creams for the children, then going inside the resort area. The twins stayed at the crèche next to the TAPAS, which was for children aged between one and two, and then he and KATE took MADELEINE to the other crèche for older children, which is located on the 1st floor at the resort’s main reception, where they arrived at around 09h50. Besides MADELEINE, from the group, only Ella, the daughter of JANE and RUSSEL, went to the same crèche. The remaining children, being very young, stayed at the crèche next to the TAPAS.

Again he went on foot, leaving the secondary reception he turned right, went down the street passing the “BATISTA” supermarket, turned left passing the main reception. After putting the children in their crèches they went to the “BATISTA” supermarket where they bought items for the following lunch and breakfast.

At around 12H30, the deponent and KATE first went to pick up MADELEINE and then the twins, going to the apartment. On this day, Sunday, they had lunch on the balcony of David Payne's apartment with the whole group, including children, except for MATHEW, who was ill and at that moment was sleeping on the balcony of his apartment that was below and to the left in relation to where they were having lunch.

They took the children to the play area next to the pool, where the playground is located, at 14H15, having stayed there until about 14H20. After that time they left the twins in the crèche at TAPAS, and either the deponent or KATE, he doesn't know who, took MADELEINE to the crèche above the main reception, following the previously described route. He clarifies that the children’s drop-off and collection times were recorded at each crèche along with the contact number and location of the respective parents.

At around 17h00 the OCEAN CLUB nannies conducted MADELEINE and the other children from the crèche on the 1st floor of the main reception to the area next to the TAPAS, under awnings, where they had dinner under the supervision of the employees and, at times, of their own parents. Dinner ended at around 17h30, the time at which the employees’ supervision ended and the parents took over watching the children in the ”TAPAS” play area until 18h30. Then they returned to the apartment, the deponent opened the main door with his key and, then, the back door through which KATE and the children entered.

After doing the hygiene, the children were put to bed about 19h30, and the deponent and KATE left for dinner at the TAPAS at around 20h30. Between 19h30 and 20h30 they took a bath and drank wine, Portuguese or New Zealand, and a beer.

They left the house through the main door, that he was sure he locked, and the back door was also closed and locked. They were the first to arrive at the TAPAS where everyone showed up except only for MATHEW, who was still ill. Nevertheless, his wife RACHEL showed up for dinner. Except for the situation described above, that occurred during lunch, he did not see MATHEW during the whole of Sunday.

Dinner ended at around 23h00, and during this period, every half-hour, the deponent and KATE went, alternately, to the apartment to confirm that all was well with the children. On that day, only the deponent and his wife entered the apartment. He is sure that they always entered through the front door, not knowing if they locked it upon leaving. Usually they entered the apartment, in which one of the living room lights was on, went to the children's bedroom door, which was ajar, and only peeped inside, trying to hear if the children were crying. The shutters were closed with only two or three slats open, the window was closed though he is not totally sure if it was locked, and the curtains drawn closed. Ten minutes after dinner ended they made their way to the apartment, going to bed right away.

On the following days they always took breakfast at home, shopping on the day before, generally maintaining the daily routine described above. When the children were at the crèches they had tennis classes, KATE at 09h15, the deponent an hour later, from Monday to Thursday.

From memory, on Tuesday, 1 May 2007, by indication from RUSSEL, he went to pick up MADELEINE at the crèche using a short-cut that began at the car park opposite the secondary reception and went between the buildings, which he used to fetch and take his daughter from then on.

Concerning the routine, on Tuesday there was a slight change given that after lunch, at 13h30, the deponent and KATE decided to take the three children to Praia da Luz, having gone on foot, taking only the twins in baby buggies. They all left by the main door because of the buggies, went around to the right, down the street of the “BATISTA” supermarket and went to the beach along a road directly ahead.

They were at the beach for about 20 minutes, the deponent and MADELEINE having put their feet in the water. During this time the weather changed with a cloudy sky and cold, therefore they went to a terrace at a café near the beach, on the left, where they bought five ice-creams and two drinks. Asked, he said that at that place there was an individual playing latin music on a guitar, to whom he intended to give some coins, but having none at the time, he didn't. That the individual had a neglected and careless appearance, unshaven and somewhat raggedy. He was Caucasian, 175cm tall, thin, 70 to 75kg in weight, dark, short hair, almost shaven-headed with grey sides, and not wearing glasses. Wearing a light brown-coloured sports jacket, with a hood at the back, and dark denim trousers, not noticing the footwear. He said that he never behaved strangely, nor approached or looked at the children in an ostensive manner. On returning they left the children at their crèches, as usual, the deponent and his wife having gone to play tennis or jogging.

On the day that MADELEINE disappeared, Thursday, 3 May 2007, they all woke up at the same time, between 07H30 and 08H00. When they were having breakfast, MADELEINE addressed her mother and asked her “why didn't you come last night when SEAN and I were crying?” (SIC). That he thought this comment very strange given that MADELEINE had never spoken like this and, the night before, they had maintained the same system of checking on the children, not having detected anything abnormal. When he questioned her about the comment, she left without any explanation.

On Wednesday night, 2 May 2007, apart from the deponent and his wife, he thinks that DAVID PAYNE also went to his apartment to check that his children were well, not having reported to him any abnormal situation with the children. On this day, the deponent and KATE had already left the back door closed, but not locked, to allow entrance by their group colleagues to check on the children. He clarifies that the main door was always closed but not necessarily locked with the key. He does not know if the window next to the front door, and that gave access to the children's bedroom, was locked, given that he assumed that the shutters could not be opened from the outside. Still on this night, KATE slept in the children's bedroom, in the bed next to the window, because the deponent was snoring.

He cannot say exactly, but he thinks that on Monday or Tuesday MADELEINE had slept for some time in his bedroom, with KATE, as she had told him that one or both twins were crying, making much noise.

Back to Thursday, after breakfast, about 09h00, KATE and the children left by the back door, the deponent having left by the front door, which he locked with the key, having also closed and locked the back door from the inside.

They made their way on foot down the usual route to the crèche next to the TAPAS, where they left the twins, and, while KATE stayed to play tennis, the deponent took MADELEINE to her crèche, through the short-cut, where they arrived at 09h15, and , since it was obligatory, he signed the child's attendance register. On returning, not by the short-cut, he went to the “BATISTA” supermarket where he bought milk, he presumes, making his way to his apartment, entering through the front door, which was locked by key, at around 09H40/09H45.

He remained at home for about 15 minutes, putting on tennis clothes, left by the front door, that he did not lock, and made his way to the tennis courts down the usual route, they being next to the TAPAS. He played tennis for an hour with the instructor and other students, among whom was an individual he had met during this holiday, called "JEZ", and with whom he had established not quite a friendship, but rather a simple acquaintance. "JEZ" has two small children whose exact age he does not know. As to his wife, he had seen her next to the pool but had never spoken with her.

The tennis class finished at 11H15, he stayed in the pool area talking with his wife and other people, whom he does not remember. At 12H00, he agreed with KATE, as he recalls it, that she would make lunch and the deponent would pick up MADELEINE. He thinks that it was KATE who took the twins home. Since it was he who went to collect MADELEINE, he is sure he used the short-cut.

At 12h30 they started lunch, the meal having lasted an hour, until 13h30. After that time they made their way to the resort play area, the deponent having left through the front door and the rest of the family through the back door that, once again, he shut and locked from the inside. As for the front door, he does not know exactly if he locked it.

They stayed in the play area for approximately an hour, until 14H30/14H35. After that, they left the twins at the crèche near the TAPAS, they signed the register, and the three of them (deponent, KATE and MADELEINE) made their way to the crèche at the main reception, where they arrived at 14H50 and delivered MADELEINE, not being able to say precisely who signed the register.

The deponent and KATE returned to the OCEAN CLUB by the short-cut and at the secondary reception they asked the lady employee if there was a vacant tennis court they could reserve. They were told there was a vacancy between 14H30 and 15H30. As it was already 15h00, they began to play immediately. At 15H30, the tennis instructor arrived, who taught them a class until 16H30.

They stayed there, talking, until 16H45, at which time the twins went to the meal area. At 17h00, as usual, MADELEINE arrived accompanied by the nannies and the other children. After her arrival, MADELEINE dined, having finished at 17H30.

After 17H30 they went to the apartment, the deponent having entered by the main door, which he did not lock while he was inside the residence. KATE and the children entered by the back door, after this had been opened from the inside by the deponent.

They bathed the children, the deponent having left at 18H00 for a tennis game only for men, which was attended by: DAN, the tennis instructor; JULIAN, with whom he had played tennis several times; and CURTIS, with whom he had also played before.

During the afternoon of that day, the rest of the group, including the children, were at the beach, having returned at 18H30, the time at which he saw DAVID PAYNE next to the tennis court. DAVID went to visit KATE and the children and returned close to 19H00, trying to convince the deponent to continue to play tennis, which he refused, as he had already been plying for about an hour and had to go back to his wife. Nevertheless, RUSSEL, DAVID and MATHEW stayed to play.

At around 19H00, he made his way to the apartment, finding KATE and the children playing on the sofa. About 10 to 15 minutes later, they took the children to the bedroom and they all sat on MADELEINE's bed to read a story. At 19H30, the twins were already in their respective cots and MADELEINE in the bed next to the bedroom door. He does not know if they were asleep but from the silence he presumed that they were. As it was still early he took a bath, he thinks that KATE had already done so, they talked a little and drank wine or beer.

At 20H35, they left the apartment towards the “TAPAS”. Before they left, and because the children's bedroom door was ajar as always, he opened it a little more, listening from the outside and, as there was complete silence, he did not even enter, returning the door to its previous position, with a space of about 10cm.

He is certain that, before leaving home, the children's bedroom was totally dark, with the window closed, but he does not know it was locked, the shutters closed but with some slats open, and the curtains also drawn closed. Asked, he mentions that during the night the artificial light coming in from the outside is very weak, therefore, without a light being lit in the living room or in the kitchen, the visibility inside the bedroom is much reduced. Despite what he said in his previous statements, he states now and with certainty, that he left with KATE through the back door which he consequently closed but did not lock, given that that is only possible from the inside. Concerning the front door, although he is certain that it was closed, it is unlikely that it was locked, because they left through the back door.

They took the usual route to the “TAPAS”, where they arrived a little after 20H35, not having passed on the route anyone known nor detected anything abnormal. Asked, he said that the dinner bookings were made since Monday, it was already the intention of the group to take their meals there. They were the first of the group to arrive, seating themselves at the biggest table, as usual, which is located in the middle between other tables, under an awning with a transparent plastic surface at the front. He mentions that they were seated at the table, in a position that allowed the deponent to see almost the entire back door of his apartment, through which they left and entered and which gave access to the living room.

He adds that, among other people whom he does not recall, at one of the small tables was the CARPENTER couple, whom he also met playing tennis and with whom they spoke until the other group members began to arrive. He does not recall the order of arrival but he has the idea that MATHEW and RACHEL were the first to arrive after the deponent. As time went by, the rest of the group arrived until all nine adults were there. At around 21H00, MATHEW stood up from the table, saying that he was going to check on the children. Nevertheless, he did not say that he would go to check on the deponent’s children, and it was only after the disappearance of MADELEINE that he told him that at 21h00 the shutters of the children's bedroom window were closed. At 21H05, MATHEW returned, the time at which the deponent left the table to go check on his children.

He walked the normal route up to the back door, which being open he only had to slide, and while he was entering the living room, he noticed that the children's bedroom door was not ajar as he had left it but half-way open, which he thought was strange, having then thought that possibly MADELEINE had got up to go to sleep in his bedroom, so as to avoid the noise produced by her siblings. Therefore, he entered the children's bedroom and established visual contact with each of them, checking and he is certain of this, that the three were deeply asleep. He left the children's bedroom returning to place the door how he had already previously described, then went to the bathroom. Everything else was normal, the shutters, curtains and windows closed, very dark, there only being the light that came from the living room.

He adds that he did not enter any other part of the residence, where he was for only two or three minutes, leaving yet again through the back door, that he closed but did not lock. He clarifies that he returned without checking any other couple’s children, even because he had not been asked to do so.

After leaving through the side gate, and while on his way to the secondary reception entrance, less than 10 metres from the gate, he saw “JEZ” walking up the street on the opposite pavement, bringing with him a baby buggy with his youngest child. He crossed the road in JEZ's direction who was walking up on the right-hand side, in the ascending direction, both having chatted for 3 to 4 minutes, about tennis, holidays and children. While talking with JEZ, he saw no-one from the group, nor detected any suspicious individual or vehicle. Because he was specifically asked, he relates that during this period of time he did certainly not see JANE passing that location, although he clarifies that he was speaking facing JEZ, with his back to the other pathway, where his apartment is situated. He also mentions that JEZ never told him that he had seen anyone, given that he was in front.

He then returned to the TAPAS, between 21h10 and 21h15, dinner having gone as normal. As the movement of people at the table was frequent, he does not know if, when he returned, anyone else was absent, namely JANE. At around 21h30 he drew KATE's attention to the fact that it was time for her to go to see the children, MATHEW having immediately volunteered to substitute her, given the fact that she was chatting. Three to four minutes later MATHEW returned, saying only "all is quiet" (SIC), he having entered through the back door, given that he did not have the key and it was usual for them to enter in that way.

After MATHEW arrived and before KATE left, he does not recall if anyone else was absent, although it was very probable that such had happened. He thinks that, on that night, none of the adults nor children were ill. Asked, he mentions that the daughter of RUSSEL and FIONA would have been ill on Tuesday.

Half and hour later, without anything to remark, it being 22h03, he again alerted KATE that it was time to check the children. She immediately made her way to the apartment by the usual path, having entered through the back door. About 10 minutes later, he started to worry about her taking so long, and, at the moment the deponent prepared to get up and to check why she was taking so long, KATE appeared running, completely distraught and crying, saying that MADELEINE had disappeared and that she was sure because she had looked throughout the entire house.

The deponent ran into the apartment accompanied by the rest of the group who, at the time, were seated at the table. When he arrived at the bedroom he first noticed that the door was completely open, the window was also open to one side, the shutters almost fully raised, the curtains drawn back, MADELEINE's bed was empty but the twins continued sleeping in their cots. He clarifies that according to what KATE told him, that was the scenario that she found when she entered the apartment.

Then he closed the shutters, made his way to the outside and tried to open them, which he managed to do, much to his surprise given that he thought that that was only possible from the inside. They continued with searches outside, around the various apartment blocks, the deponent having asked MATHEW to go to the secondary reception in order to communicate the fact to the local police, since he had no doubt that his daughter had been abducted. He refutes, peremptorily, the possibility that MADELEINE could have left the apartment by her own means.

The deponent had had the wrong idea that MATHEW had seen the bedroom shutters closed when he was there at 21H30, and therefore he thought the disappearance would have taken place between 21h30 and 22h00, but presently he is fully convinced that the abduction took place during the period of time between his check at 21h05 and MATHEW's visit at 21H30. It was not until about 01h00 on 4 May 2007 that he learned through RUSSEL that his partner, JANE, at around 21h10, saw a man crossing the top of the road with a child in his arms, that may or may not have been his daughter MADELEINE. Asked, he mentions that he does not recall describing the exact type of pyjamas (colour, designs, etc.) that MADELEINE was wearing at the time she disappeared. The photo of his daughter MADELEINE, after having printed several at the hotel reception, was delivered this police’s agents on location, as well as to other persons who were there.

Asked, he stated that apart from her own apartment, MADELEINE only ever entered DAVID and FIONA’s apartment, although it was common that they frequented each others' apartments.

That, between Monday and Wednesday, not knowing the precise date, when they were leaving the residence through the main door, to place the children in the respective crèches, MADELEINE left running to the left, to the extreme opposite of the residential blocks where they were lodged, playing with the twins. That they walked down next to the most remote end of one of those blocks, not knowing exactly which one, and the three children got into one of the gardens at the back. Then they walked down the inside alley at the back, next to the hedges, up to the street that led to the secondary reception.

He peremptorily denies that anyone in the group mat be directly or indirectly involved in the disappearance of his daughter. He presumes that, when his wife alerted him about her disappearance, all the group members were seated at the table. He mentions that, also during the dinner, none of the members complained about being ill or manifested any strange behaviour; there was a relaxed atmosphere.

During the holidays he did not hire or borrow any motor vehicle, nor did he used a taxi or any other form of transport. He further clarifies that the only time MADELEINE accompanied them to the beach was the one described above, although she went to the beach in Luz three more times, one of those to go sailing, but always in the company of crèche nannies. Two of these trips took place after the date on which she was there with her parents. That, with respect to those episodes, MADELEINE never mentioned to him that anything strange had happened.

Asked, he mentions that on Thursday, 3 May 2007, there was nobody from outside of the group seated at the table, nor does he know any person with the name IRWIN.

Concerning the bed where his daughter was on the night she disappeared, he says that she slept uncovered, as usual when it was hot, with the bedclothes folded down. Concerning the other bed next to the window in the children's bedroom, he says that it showed no signs that anyone had put their feet on it, namely, dirt or shoe prints.

Concerning the half-hourly checking of the children, it had been inspired by the MARK WARNER system called "baby listening", as referred to previously. On the night of the events, he ate fish at dinner, and sausages and potatoes as a starter, drinking white wine. Usually, between 20h30 and the end of dinner, they would drink more or less a bottle of wine per person.

Asked, he says that KATE never told him anything about her having "a bad presentiment" concerning this trip.

He has no suspicion whatsoever, nor has he any enemies, something that applies equally to his wife, KATE. That, in the course of his profession, he never made any error, nor was he guilty of anything, except one time in 2000, when an unknown man entered the hospital where he worked, making incoherent threats without justification and calling out his name.

------ Por lhe ter sido perguntado, refere que, no ano de 2003 (Janeiro), se deslocou a Lanzarote, em Espanha, na companhia de FIONA e DAVID PAYNE, onde passaram uma semana de férias, sendo que nessa altura ainda não tinham filhos. Nessa altura, apesar de ainda não terem filhos, a KATE encontrava-se grávida de 6 meses da MADELEINE, sendo que a gravidez foi através de fertilização in vitro. Ainda no ano de 2003 (Setembro), deslocou-se a Itália, à região de Umbria, na companhia da sua esposa KATE, dos casais MATHEW e RACHEL, RUSSEL e JANE, onde passaram uma semana de férias, a fim de assistir ao casamento da FIONA e DAVID PAYNE. O depoente esclarece que a viagem a Lanzarote foi organizada por si próprio, uma vez que tinha lá estado um ano antes, juntamente com a KATE e tinham gostado muito, sendo que a viagem a Itália, foi organizada pela FIONA e o DAVID PAYNE, uma vez que era o seu casamento. ---------
----- Relativamente aos factos ocorridos em Portugal, conforme já referiu nas suas anteriores declarações, chegou ao Aeroporto de Faro no pretérito dia 28/04/2007, pelas 12H30, tendo-se deslocado de imediato para o "OCEAN CLUB", num mini-bus cedido pelo Aeroporto, onde chegou pelas 14H20/14H30. ....................................................................................
----- Que se dirigiu para a recepção do "OCEAN CLUB", onde forneceu os seus documentos, os da KATE e dos seus três filhos, efectuando o Chek-in. Foi-lhe então entregue a chave do apartamento "A5", tendo a escolha do referido apartamento sido da integral responsabilidade da gerência do "OCEAN CLLB" e efectuada de forma aleatória, uma vez que, segundo sabe, não foi dada essa possibilidade ao DAVID PAYNE, que foi que mais tratou directamente das reservas. ----
----- Acrescenta que, a única imposição do grupo, foi ficarem em apartamentos que ficassem perto uns dos outros, uma vez que, contrariamente ao que lhes tinha sido comunicado através da brochura da viagem, o complexo turístico não dispunha de "baby listening", que se trata de um serviço constituído por um grupo de funcionários que têm por função "vigiar" as crianças que se encontram a dormir no interior dos apartamentos, nos períodos em que os pais se ausentam. Não sabe como se processa essa vigilância na prática, uma vez que nunca usufruiu desse serviço, mas sabe que outros empreendimentos do "MARK WARNER", possuem essa valência, sendo que alguns dos elementos que constituem o grupo, já teriam tido acesso a esse serviço em períodos de férias anteriores, não sabendo precisar quem. Refere que, por esta razão, o DAVID PAYNE decidiu usar os intercomunicadores pessoais para monitorizar os seus filhos, sendo que nunca o tinha feito durante os anteriores periodos de férias que passaram juntos. .................................
----- Que, no primeiro dia, uma vez que chegaram durante a hora de almoço, comeram apenas sandes, quer no avião, quer no autocarro, durante o trajecto entre o aeroporto e o "OCEAN CLUB". Após efectuarem o chek in na recepção principal, onde foram deixados pelo mini-bus, o que demorou até às 15H00, dirigiram-se para o apartamento onde retiraram os seus artigos/objectos pessoais do interior das malas, o que terá ocupado a tarde até às 16H45. De salientar que, após efectuarem o Ckek in, o trajecto com as malas para o apartamento foi efectuado num mini-bus disponibilizado pelo empreendimento. .........................................................................
----- De seguida, pelas 17H00, dirigiu-se todo o grupo, crianças incluídas, para o restaurante "TAPAS", situado nas traseiras do apartamento, junto a piscina, a fim de assistirem a um comité de boas vindas, organizado pela "MARK WARNER", e onde estavam presentes os professores de ténis, de vela, entre outros funcionários daquele empreendimento, o que terminou pelas 18H30, tendo-lhes sido servidos copos de sangria. ------------------------------------------------------------
----- Que este foi o primeiro trajecto pedonal que fizeram todos juntos no interior e imediações do empreendimento. Saíram pela porta da frente, fechou-a a chave, contornou o muro ali existente e virou à direita, descendo a rua lateral ao empreendimento até à recepção secundária, onde entraram sem dificuldade, ainda que tivessem um cartão de circulação, o qual não lhes foi pedido e que lhes tinha sido entregue durante o Chek in. .........................................................................
----- Após transporem a recepção secundária, dirigiram-se ao restaurante "TAPAS", junto a uma das piscinas, tendo os adultos se sentado numa área coberta, mas exterior, enquanto que as crianças ficaram junto a piscina pequena, a brincarem numas estruturas que ali estão colocadas. Que, durante este periodo de tempo, todos os adultos se levantaram para irem vigiar as crianças junto do local onde estas se encontravam. Tanto o depoente como a sua esposa, alternaram nessa vigia. ------
----- Terminado o comité de recepção, dirigiram-se a pé para o restaurante "MILLENIUM", os nove adultos e as oito crianças. Fizeram o trajecto inverso até à recepção secundária, aí viraram a esquerda e, no final desta rua, à direita, depois na próxima a esquerda, novamente direita, até a rua principal, que permite aceder ao restaurante. Por ser um trajecto longo, a determinada altura o depoente e a esposa KATE tiveram de levar os gémeos ao colo, ao contrário da MADELEINE, que foi sempre a pé. ..............................................................................................
----- Chegaram ao destino entre as 18H50 e as 19H00, tendo-lhes sido montada uma mesa de grandes dimensões, onde estiveram todos a jantar, incluindo as crianças, que se sentaram entre os adultos, nunca abandonando aquele local, exceptuando um dos gémeos, que foi à casa de banho com o depoente. Cerca de uma hora depois, terminaram o jantar, regressando igualmente a pé pelo mesmo trajecto, tendo contudo se enganado numa das ruas, onde deveriam virar à esquerda, acabando por apenas virar na seguinte. Acrescenta que, por estarem muito cansados, se dirigiram directamente para o apartamento, onde chegaram pelas 20H10/20H15, tendo este trajecto sido ligeiramente mais rápido que o anterior, uma vez que trouxeram sempre os gémeos ao colo. --------
----- Já no interior do apartamento, deram banho as crianças e um copo de leite, tendo-as deitado precisamente às 20h45, recordando-se desta hora, uma vez que era exactamente uma hora mais tarde daquela que é habitual. Após deitarem os filhos, o depoente e a sua esposa tomaram banho, dirigindo-se de seguida para a sala da residência para ver televisão. Salienta que, no momento em que chegaram à residência, o DAVID PAYNE convidou-os para irem beber um copo de vinho, após deitarem as crianças, tendo estes recusado, uma vez que se encontravam extremamente cansados. Pensa que ninguém do grupo terá saído dos apartamentos na primeira noite. Perguntado, disse que, não estando de férias, em Inglaterra, o depoente e a sua esposa, vão para a cama às 22H30/23H00, os gémeos às 19H00 e a MADELEINE às 19H30. ......................................
----- No dia seguinte (Domingo), as crianças acordaram às 08H00, sendo que o depoente e a sua esposa acordaram pelas 07H30. Vestiram-se e, cerca das O8H40, saíram do apartamento em direcção ao restaurante "MILLENIUM", mais uma vez a pé e pelo mesmo trajecto, da noite anterior, mas sem o lapso que anteriormente referiu, tendo chegado pelas 08H45/09H00. O grupo não chegou todo ao mesmo tempo, tendo chegado de forma faseada, pelo que não se sentaram todos na mesma mesa. ............................................................................................
----- Pensa que o MATHEW e a sua esposa RACHEL, não terão tomado o pequeno almoço, em virtude do primeiro ter passado mal a noite com vómitos e diarreia. Ao pequeno almoço, as crianças sentaram-se igualmente à mesa entre os adultos, tendo este terminado pelas 09H25. --------
----- O depoente, a esposa KATE e os seus três filhos, dirigiram-se para o "OCEAN CLUB" pelo mesmo trajecto, onde chegaram pelas 09h40, tendo o depoente entrado no seu apartamento pela porta principal, a qual se encontrava fechada à chave, retirando um saco com roupa e cremes para as crianças, dirigindo-se para o interior do empreendimento. Os gémeos ficaram na "creche" junto ao "TAPAS", que se destina a crianças de um a dois anos de idade e, em seguida, o depoente e a KATE, levaram a MADELEINE para outra "creche", própria para crianças de maior de idade, a qual se situa no 1.º piso da recepção principal do empreendimento, onde chegaram pelas 09H50. Para além da MADELEINE, do grupo, apenas a E**a, filha da JANE e do RUSSEL, frequentava igualmente esta "creche". As demais crianças, por serem muito jovens, ficavam na "creche" junto ao "TAPAS". ...................................................................................
----- Mais uma vez fez o trajecto apeado, saindo da recepção secundária, virou à direita, desceu a rua, passando pelo supermercado "BATISTA", virando à esquerda, passando pela recepção principal. Após colocarem as crianças nas "creches", dirigiram-se ao supermercado "BATISTA", onde compraram para o almoço e pequeno almoço seguintes. .............................................
----- Pelas 12H30, o depoente e a KATE, foram buscar primeiro a MADELEiNE e depois os gémeos, dirigindo-se para o apartamento. Neste dia, Domingo, almoçaram na varanda do apartamento do DAVID PAYNE, juntamente com todo o grupo, incluindo crianças, exceptuando o MATHEW, que se encontrava doente e, nesse momento, estava a dormir na varanda do seu apartamento, que fica por baixo e à esquerda, em relação ao local onde almoçavam. ------------------
----- Dirigiram-se para a zona de recreio das crianças, junto à piscina, onde se encontravam as estruturas, quando eram 14H15, tendo permanecido naquele local até cerca das 14H20. Após essa hora, deixaram os gémeos na "creche" do "TAPAS" e, ou o depoente, ou a KATE, não sabe precisar, levaram a MADELEINE para a "creche" situada por cima da recepção principal, seguindo o trajecto já descrito. Esclarece que, a hora de entrada e de saída das crianças ficava
registada em cada um das "creche", bem como, o número de contacto e a localização dos respectivos pais. ...................................................................................................
----- Pelas 17H00, as educadoras do "OCEAN CLUB", conduziram a MADELEINE e as restantes crianças que se encontravam na "creche" situada no 1.º piso da recepção principal, para junto do "TAPAS", por baixo de uns toldos, onde jantaram, sob a vigilância dos funcionários e, as vezes, dos próprios pais. O jantar terminou pelas 17H30, altura em que cessou a vigilância das funcionárias, sendo agora o depoente e a sua esposa que as vigiavam na zona de recreio do "TAPAS" até às 18H30. De seguida, regressaram ao apartamento, o depoente abriu a porta principal com a chave e, logo depois, a porta das traseiras, por onde entrou a KATE e os seus filhos. ...............................................................................................................
----- Efectuada a higiene, as crianças foram-se deitar quando eram cerca das 19830, sendo que o depoente e a KATE, saíram para jantar no "TAPAS", pelas 20H30. Entre as 19H30 e as 20H30, tomaram banho e beberam vinho, português ou neozelandês, e uma cerveja. ............................
------ Que saíram de casa pela porta principal, que tem a certeza que fechou a chave, sendo que a porta das traseiras se encontrava igualmente fechada e trancada. Foram os primeiros a chegar ao "TAPAS", onde compareceu todo o grupo, exceptuando apenas o MATHEW, que ainda estava doente. Todavia a sua esposa RACHEL, compareceu ao jantar. Exceptuando a situação atrás descrita, que ocorreu durante a hora de almoço, não viu o MATHEW durante todo o dia de Domingo. ...........................................................................................................
----- O jantar terminou pelas 23H00, sendo que, durante este período, de meia em meia hora, o depoente e a KATE foram ao apartamento, de forma alternada, a fim de confirmar se estava tudo bem com as crianças. Nesse dia, somente o depoente e a sua esposa KATE é que entraram no apartamento. Tem a certeza que entraram sempre pela porta da frente, não sabendo indicar se à saída a trancavam com a chave. Normalmente, entravam no apartamento, que se encontrava com
uma das luzes da sala ligada, dirigiam-se à porta do quarto das crianças, que se encontrava entreaberta e limitavam-se a espreitar para o interior, procurando ouvir se as crianças estavam a chorar. Os estores estavam fechados, apenas com duas ou três frestas abertas, a janela fechada, embora não saiba precisar se estava trancada, e os cortinados corridos. Dez minutos após o fim do jantar, dirigiram-se para o apartamento, deitando-se logo de seguida. ....................................
----- Nos dias seguintes, tomaram sempre o pequeno almoço em casa, fazendo as compras de véspera, tendo mantido genericamente a rotina diária anteriormente descrita. Quando as crianças estavam nas "creches" tinham aulas de ténis, a KATE as 09H15 e o depoente uma hora depois, de Segunda a Quinta-feira. .......................................................................................
----- Segundo se recorda, na Terça-feira, dia 01/05/2007, por indicação do RUSSEL, foi buscar a MADELEINE à "creche" através de um atalho, que se inicia no parque de estacionamento situado em frente à recepção secundária e que segue entre as habitações ali existentes, por onde passou a levar e a trazer a sua filha. ......................................................................
----No tocante à rotina, na terça-feira houve uma ligeira alteração, uma vez que, depois de almoço, pelas 13H30, o depoente e a KATE decidiram levar os três filhos à Praia da Luz, tendo ido a pé, levando apenas os gémeos nos carrinhos para bebé. Saíram todos pela porta principal por causa dos carrinhos, contornaram a direita, desceram a rua do supermercado "BATISTA", e foram para a praia por uma artéria que acede directamente. ................................................................
------ Na praia mantiveram-se cerca de 20 minutos, tendo inclusive o depoente e a sua filha MADELEINE colocado os pés dentro de água. Decorrido este tempo e porque as condições meteorológicas se alteraram, com céu encoberto e frio, foram para uma esplanada de um café junto a praia, a esquerda, onde compraram cinco gelados e duas bebidas. Perguntado, disse que no local se encontrava um indivíduo a tocar uma guitarra, música latina, a quem até pretendia
dar uma moeda, mas como não possuía no momento, não o fez. Que este indivíduo tinha um aspecto desleixado e descuidado, com a barba por fazer e algo andrajoso. Era caucasiano, 175 cm de altura, magro, 70 a 75 kg de peso, cabelo escuro e curto, quase rapado e pelo lado grisalho e que não usava óculos. Vestia um kispo de cor castanha, claro, com um capuz sobre as costas e calças de ganga escuras, não reparando nos sapatos. Disse que ele nunca teve um
comportamento estranho, nem abordou ou olhou para as crianças de forma ostensiva. De regresso, deixaram as crianças nas "creches", como habitualmente, tendo o depoente e a sua esposa ido jogar ténis ou fazer jogging. .....................................................................................
----- No dia em que MADELEINE desapareceu, quinta-feira, dia 03/05/2007, acordaram todos ao mesmo tempo, entre as 07H30 e as 08H00. Quando estavam a tomar o pequeno almoço, a MADELEINE dirigiu-se à mãe e perguntou-lhe "porque é que não vieste à noite, quando eu e o SEAN estávamos a chorar?" (SIC). Que achou este comentário bastante estranho, uma vez que a MADELEINE nunca tinha tido este tipo de conversa e, na noite anterior, tinham mantido o mesmo sistema de vigilância sobre as crianças, não tendo detectado nada de anormal. Quando a questionou sobre este comentário, ela afastou-se sem qualquer explicação. ...........................................
----- Na noite de quarta-feira, dia 02/05/2007, para além do depoente e a sua esposa, pensa que o DAVID PAYNE também se terá deslocado ao seu apartamento, a fim de confirmar se os seus filhos estavam bem, não lhe tendo reportado qualquer situação anormal com as crianças. Neste dia, o depoente e a KATE já deixavam a porta das traseiras fechada, mas não trancada, por forma a possibilitar a entrada dos seus colegas de grupo, a fim de vigiarem as crianças. Esclarece que a porta de entrada principal ficava sempre fechada, mas não necessariamente trancada com a chave. Desconhece se a janela que ladeia a porta principal e que dá acesso ao quarto das crianças, estava trancada, uma vez que presumiu que os estores não poderiam ser abertos do exterior. Ainda nesta noite, a KATE dormiu no quarto das crianças, na cama junto à janela, porque o depoente estava ressonar. .......................................................................................
----- Não sabe indicar com precisão, mas pensa ter sido na segunda ou terça feira, a MADELEINE, esteve a dormir alguns instantes no seu quarto, com a KATE, uma vez que aquela lhe disse que um ou os dois gémeos estavam a chorar, causando muito ruído. ...............................................
----- Voltando a quinta-feira, após o pequeno almoço, cerca das 09H00, a KATE e as crianças saíram pela porta das traseiras, tendo o depoente saído pela porta da frente, que trancou com a chave, tendo igualmente fechado e trancado, por dentro, a porta das traseiras. ..........................
----- Dirigiram-se pelo caminho habitual e a pé, até à "creche" junto do "TAPAS", onde deixaram os gémeos, e, enquanto a KATE ficou a jogar ténis, o depoente foi levar a MADELEINE à sua "creche", através do atalho, onde chegou pelas 09H15, e, como era obrigatório, assinou o livro de registo de entrega da filha. No regresso, sem ser pelo atalho, foi ao supermercado "BATISTA", comprou leite, presume, dirigindo-se para o seu apartamento, entrando pela porta da frente, que estava fechada à chave, quando eram 09H40/09H45. .......................................................
------ Permaneceu em casa cerca de 15 minutos, vestindo roupa para ir jogar ténis, saiu pela porta da frente, que não fechou a chave, e dirigiu-se para os courts de ténis pelo caminho habitual, já que estes ficam junto ao "TAPAS". Durante uma hora esteve a jogar ténis com o professor e outros alunos, entre os quais se encontra um indivíduo que conheceu durante este período de férias, de nome "JEZ", com o qual não estabeleceu propriamente uma relação de amizade, mas sim um trivial conhecimento. O "JEZ" tem dois filhos menores, cuja idade não sabe precisar. Quanto à
esposa desse, refere que chegou a vê-la junto à piscina, mas nunca falou com ela. .....................
----- Terminada a aula de ténis pelas llH15, manteve-se na zona de piscina, conversando com a sua esposa outras pessoas, que não se recorda. Pelas 12H00, combinou com a KATE, pelo que se recorda, que ela fazia o almoço e o depoente iria buscar a MADELEINE. Pensa que, terá sido a KATE quem levou os gémeos para casa. Sendo o depoente que foi buscar a MADELEINE, seguramente que fez os trajectos através do atalho. ..........................................................
----- Pelas 12H30, começaram a almoçar, tendo esta refeição se prolongado durante uma hora, até às 13H30. Após esta hora, dirigiram-se para a área de recreio do empreendimento, tendo o depoente saído pela porta da frente e a restante família pela porta das traseiras que, mais uma vez, fechou e trancou por dentro. Quanto à porta da frente, não sabe precisar se a fechou à chave. --------
----- Que ficaram na área de recreio durante aproximadamente uma hora, até às 14H30/14H35. Logo após, deixaram os gémeos junto à "creche" do "TAPAS", assinaram o registo e dirigiram-se os três (depoente, KATE e MADELEINE), para a "creche" da recepção principal, onde chegaram pelas 14H50 e entregaram a MADELEINE, não conseguindo precisar quem é que assinou o livro de registos. .........................................................................................................
----- O depoente e KATE regressaram ao "OCEAN CLUB" pelo atalho e uma vez na recepção secundária, perguntaram à funcionária se existia alguma vaga para reservar o court de ténis. Nesta altura, foram informados que existia uma vaga entre as 14H30 as 15H30. Como já eram 15h00, iniciaram de imediato a prática desportiva. Pelas 15H30, chegou o professor de ténis, que lhes ministrou uma até às 16H30. .............................................................................
------ Permaneceram naquele local até as 16H45 a conversar, altura em que os gémeos foram para a zona das refeições. Pelas 17H00, como era habitual, chegou a MADELEINE acompanhada das educadoras e de outras crianças. Após a chegada, a MADELEJNE jantou, tendo terminado pelas 17H30. ..............................................................................................................
------ Após as 17H30 foram para o apartamento, tendo o depoente entrado pela porta principal, que não fechou à chave, enquanto esteve no interior da residência. A KATE e as crianças entraram pela porta das traseiras, após esta ter sido aberta por dentro pelo depoente. ...................................
------ Que deram banho às crianças, tendo o depoente saído às 18H00, para um jogo de ténis só entre homens, ao qual compareceram: DAN, professor de ténis; JULIAN, com quem praticou ténis por diversas vezes; e CURTIS, com quem também já tinha jogado. ......................................
------ Durante a tarde desse dia, os restantes elementos do grupo, incluindo as crianças, foram à praia, tendo regressado pelas 18H30, altura em que viu o DAVID PAYNE junto ao court de ténis. O DAVID foi visitar a KATE e as crianças e regressou perto das 19H00, tentando convencer o depoente a continuar a jogar ténis, ao que não acedeu, em virtude de já se encontrar a jogar à cerca de uma hora e ter de regressar para junto da sua esposa. Ainda assim, RUSSEL, DAVID e MATHEW ficaram a jogar. -------------------------------------------------------------------------------------
----- Pelas 19H00, dirigiu-se para o apartamento, encontrando-se a KATE e as crianças a brincar no sofá. Cerca de 10 a 15 minutos depois, levaram as crianças para o quarto e sentaram-se todos na cama da MADELEINE a ler uma história. Pelas 19H30, já estavam os gémeos nos respectivos berços e a MADELEINE na cama junto à porta de entrada do quarto. Não sabe se estavam a dormir, mas pelo silêncio, presume que sim. Como ainda era cedo, o depoente tomou banho, pensa que a KATE já o tinha feito, conversaram um bocado e beberam vinho ou cerveja. -------------------
----- Pelas 20H35, saíram do apartamento em direcção ao "TAPAS". Ainda antes de saírem, e porque a porta do quarto das crianças estava entreaberta como sempre, abriu-a mais um pouco, encostou o ouvido no exterior e, como estava tudo em completo silêncio, nem sequer entrou, voltando a encostar a porta para a posição anterior, com um espaço de cerca de 10 cm. ---------------
----- Tem a certeza que, antes de sair de casa, o quarto das crianças estava todo escuro, com a janela fechada. mas não sabe se trancada, os estores corridos mas com algumas frinchas abertas e os cortinados também corridos. Perguntado, refere que, durante a noite, a luz artificial proveniente do exterior é muito fraca, pelo que, caso não esteja ligada a luza da sala ou da cozinha, a visibilidade no interior do quarto é muito reduzida. Apesar do que referiu nas suas declarações anteriores, refere agora e tem a certeza, que saiu com o KATE pela porta das traseiras, que consequentemente ficou fechada, mas não trancada, uma vez que tal só é possível pelo interior. Relativamente à porta da frente, embora tenha a certeza que estava fechada, é pouco provável que estivesse fechada à chave, uma vez que saíram pela porta das traseiras. ---------------
----- Fizeram o percurso normal até ao "TAPAS", onde chegaram pouco depois das 20H35, não tendo neste trajecto se cruzado com ninguém conhecido ou detectado algo de anormal. Perguntado, disse que os jantares ficaram logo marcados desde a Segunda-feira, já que era pretensão do grupo ali fazerem as refeições. Foram os primeiros do grupo a chegar, sentando-se na maior mesa, como habitualmente, a qual se situa no meio entre as outras mesas, sob um toldo, com uma superfície em plástico transparente à frente. Refere que se sentaram à mesa, numa posição que permitia ao depoente vislumbrar quase a totalidade da porta traseira do seu apartamento, por onde saíam e entravam e que dava acesso à sala.
----- Adianta que, além de outras pessoas de que não se recorda, estava numa das mesas pequenas, o casal CARPENTER, que também conheceu a jogar ténis e com falaram até começarem a chegar os outros elementos do grupo. Não se recorda da ordem de chegada, mas tem a ideia que terá sido o MATHEW e a RACHEL, os primeiros a chegar após o depoente. Com o decorrer do tempo foram chegando os restantes elementos do grupo, até ao total dos nove adultos. Pelas 21H00, o MATHEW levantou-se da mesa, dizendo que ia ver os filhos. Contudo, não disse que iria ver os filhos do depoente, tendo, só depois do desaparecimento da MADELEINE lhe dito que as 21H00, os estores da janela do quarto das crianças estava fechado. Pelas 21H05, o MATHEW regressou, altura em que o depoente se levantou da mesa, para ir verificar como se encontravam os seus filhos.
----- Efectuou o trajecto normal até à porta das traseiras, a qual estando aberta, somente teve de a deslocar, sendo que, à medida que foi entrando na sala, verificou que a porta do quarto das crianças estava, não entreaberta conforma a tinha deixado, mas sim aberta até meio, o que considerou estranho, tendo então colocado a hipótese da MADELEINE se ter levantado para ir dormir para o seu quarto, de forma a evitar o ruído produzido pelos irmãos. Nesta medida, entrou no quarto das crianças e estabeleceu contacto visual com cada uma delas, verificando e tem a certeza disso, que os três dormiam profundamente. Saiu do quarto das crianças, voltando a encostar a porta como já anteriormente referiu, dirigindo-se à casa-de-banho. Tudo o resto estava normal, estores, cortinados e janelas fechadas, muito escuro, só existindo a luz que provinha da sala. --------
----- Acrescenta que não entrou em mais nenhuma divisão da residência, onde permaneceu apenas cerca de dois a três minutos, saindo de seguida outra vez pela porta das traseiras, que fechou, mas não trancou. Esclarece que regressou sem ver as crianças de qualquer outro casal, até porque tal não lhe foi solicitado. .............................................................................................
----- Após sair pelo portão lateral, e quando se dirigia para entrada da recepção secundária, a menos de 10 metros de distância do referido portão, verificou que o "JEZ" ia a subir aquela rua no passeio contrário, trazendo consigo um carrinho de bebé com o seu filho mais novo. Atravessou a rua na direcção do "JEZ", que subia pelo lado direito, sentido ascendente, tendo ambos conversado durante cerca de 3 a 4 minutos, sobre ténis, férias e crianças. Enquanto se manteve a conversar com o "JEZ", não viu ninguém do grupo, nem detectou qualquer indivíduo ou veículo suspeito. Por lhe ter sido especificamente perguntado, refere que, durante este período de tempo, não viu com toda a certeza a JANE passar naquele local, embora esclareça que se encontrava a falar de frente para o "JEZ", de costas para o outro passeio, onde se situa o seu apartamento. Refere também que o "JEZ" nunca lhe disse que tinha visto qualquer pessoa, uma vez que ele se encontrava de frente. .............................................................................................
----- De seguida, regressou ao "TAPAS", entre as 21H10 e as 21H15, tendo o jantar decorrido dentro da normalidade. Como a movimentação das pessoas na mesa era frequente, não sabe se quando regressou, estava alguém ausente, nomeadamente a JANE. Pelas 21H30, o depoente chamou à atenção a KATE para o facto de estar na hora de ir ver as crianças, tendo o MATHEW de imediato se voluntariado para a substituir, uma vez que ela estava a conversar. Três a quatro minutos depois, o MATHEW regressou, dizendo apenas "está tudo calmo" (SIC), tendo este entrado pela porta das traseiras, uma vez que não tinha chave e era habitual, entrarem por esse local. ----------------------------------------------------------------------------------------------
----- Após a chegada do MATHEW e antes da saída da KATE, não se recorda se alguém se terá ausentado, embora seja bastante provável que tal terá sucedido. Pensa que, nessa noite, nenhum dos adultos ou das crianças se encontrava doente. Perguntado, refere que a filha do RUSSEL e da FIONA, terá estado doente na Terça-feira. ..................................................................
------ Decorrida meia hora, sem nada a assinalar, sendo 22H03, voltou a alertar a KATE que estava na hora de ir ver a crianças. Essa acedeu de imediato e dirigiu-se ao apartamento pelo caminho normal, tendo entrado pela porta das traseiras. Cerca de 10 minutos depois, começou a estranhar a demora e, no momento em que o depoente se preparava para se levantar, e ir ver o motivo da demora, a KATE apareceu a correr, completamente destroçada e a chorar, dizendo que a MADELEINE tinha desaparecido e que tinha a certeza porque já tinha procurado pela casa toda. --
----- O depoente seguiu a correr para o interior do apartamento, sendo acompanhado pelos restantes elementos do grupo que, na altura, se encontravam sentados a mesa. Quando chegou ao quarto, em primeiro verificou que a porta se encontrava completamente aberta, a janela também aberta para um dos lados, os estores subidos, quase na totalidade, os cortinados afastados, a cama da MADELEINE estava vazia, mas os gémeos continuavam nos berços a dormir. Esclarece que, segundo lhe comunicou a KATE, foi este o cenário que ela encontrou, quando chegou ao apartamento. .......................................................................................................
----- Em seguida, fechou os estores, dirigiu-se para o exterior e tentou abri-los, o que conseguiu, sendo uma surpresa, uma vez que pensava que tal apenas era possível a partir do interior. Continuaram com as buscas no exterior, à volta dos vários blocos de apartamentos, tendo o depoente solicitado ao MATHEW que se deslocasse a recepção secundária para o facto fosse comunicado a Polícia local, pois não tinha qualquer dúvida de que a sua filha tinha sido raptada. Refuta de forma peremptória a hipótese de que a MADELEINE possa ter saído do apartamento
pelos seu próprios meios. .......................................................................................
----- O depoente tinha ficado com a ideia errada de que o MATHEW tinha visto os estores do quarto fechados, quando ali se deslocou pelas 21H30, razão pela qual pensava que o desaparecimento se teria processado entre as 21H30 e as 22H00, sendo que, actualmente, está pelnamente convicto que o rapto terá ocorrido no período compreendido entre a sua visita das 21h05 e a visita do MATHEW às 21H30. Só cerca da 01H00 do dia 04/05/2007, é que teve conhecimento através do RUSSEL que a sua companheira JANE, pelas 21H10, teria visto um indivíduo a cruzar o cimo da rua com uma criança ao colo, que poderia ou não ser a sua filha MADELEINE. Perguntado, refere que não se recorda de ter descrito em concreto o tipo de pijama (cor, desenhos, etc.) que a MADELEINE tinha vestido no momento em que desapareceu. A fotografia da sua filha MADELEINE, após ter imprimido várias, na recepção do hotel, entregou aos elementos desta Polícia que se deslocaram ao local, bem como, a outras pessoas ali presentes.
----- Perguntado, referiu que, para além do seu próprio apartamento, a MADELEINE só chegou a entrar no apartamento do DAVID e FIONA, ainda que fosse hábito frequentarem os apartamentos uns dos outros. .....................................................................................................
----- Que, entre segunda e quarta-feira, não sabendo precisar a data, quando saíam da residência pela porta principal, para colocarem as crianças nas respectivas "creches", a MADELEINE saiu a correr pela esquerda, em relação ao extremo oposto dos blocos residenciais onde se encontravam alojados, brincando com os gémeos. Que terão descido junto à extremidade mais afastada de um desses blocos, não sabendo precisar qual, tendo as três crianças chegado a entrar para um dos jardins que existem nas traseiras. De seguida, seguiram pelo corredor interior existente nas traseiras, junto às sebes, até à rua que dá acesso à recepção secundária. ..................................
----- Nega peremptoriamente que alguém do grupo possa estar directa ou indirectamente envolvido no desaparecimento da sua filha. Presume que, quando a sua esposa o alertou para o seu desaparecimento, todos os elementos do grupo estariam sentados à mesa. Refere que, também durante o jantar, nenhum dos elementos se queixou de estar doente ou manifestou algum comportamento estranho, reinando um ambiente de descontracção. .....................................
----- Durante o período de férias, não alugou ou pediu emprestado qualquer veículo automóvel, não tendo igualmente utilizado táxi ou outro meio de transporte. Esclarece ainda que, a única vez que a MADELEINE os acompanhou à praia, foi a que acima descreveu, embora a criança tenha ido a praia da Luz mais três vezes, uma delas para velejar, mas sempre na companhia dos funcionários da "creche". Duas destas deslocações, concretizaram-se após a data em que ali se deslocou na companhia dos pais. Que, relativamente a esses episódios, nunca lhe foi dito pela MADELEINE que algo estranho tinha acontecido, ............................................................................
------ Perguntado, refere que, na quinta-feira, dia 03/05/2007, não estava ninguém sentado na mesa, estranho ao grupo, sendo que não conhece qualquer pessoa com o nome "IRWIN". -----------
----- Ainda relativamente à cama onde a sua filha se encontrava na noite em que desapareceu, refere que essa dormiu destapada, como era habitual quando estava calor, com a roupa dobrada para baixo. Relativamente à cama do quarto das crianças que se encontrava junto à janela, refere que a mesma não apresentava quaisquer sinais evidentes de que alguém ali tenha colocado os pés, nomeademente, sujidade ou marcas de calçado.
----- No que concerne à vigilância de meia em meia hora feita as crianças, surgiu por inspiração do sistema que a "MARK WARNERS" possui e que se designa por "baby listening", tal como já anteriormente referiu. Na noite em que ocorreram os factos, comeu peixe ao jantar e salsichas e batatas de entrada, bebendo vinho branco. Normalmente, entre o período das 20h30 e o final do jantar, bebiam mais ou menos garrafa de vinho por pessoa. ...........................................
----- Perguntado, refere que a KATE nunca lhe transmitiu qualquer ideia de que teria "um mau pressentimento" relativamente a esta viagem. ................................................................
----- Não possui qualquer tipo de suspeita, nem tem inimigos, situação esta que se aplica igualmente à sua esposa KATE. Que, no decurso da sua profissão, nunca cometeu qualquer erro, nem de nada foi culpado, exceptuando uma vez, no decurso do ano 2000, em que um indivíduo desconhecido entrou no hospital onde trabalhava, efectuando ameaças sem qualquer nexo nem justificação e chamando pelo seu nome.
