She comes to the process as a witness. Being of British nationality, she does not speak or write Portuguese and the interpreter Nuno José Cruz de Magalhaes Mexia Bulhoes is present.

She confirms the integrity of the statements made to this Police Department on 04/05/2007 and is ready to provide any additional clarifications.

She stayed in apartment "5B", which is located immediately next to the apartment of the McCann family. That on 03/05/2007, Thursday, she got up between 06H30 and 07:00, together with her husband Mathew and their daughter G***e aged 19 months.

At 07H50, they went to the "MILLENNIUM" restauarant, on foot, arriving at about 08.00 to have breakfast. She stated that they had been the first members of the group to arrive, and, later David and Fiona arrived with their two children, then Russel with his children. Jane did not come because that morning she was not feeling well. They took the usual route, alone, having left the apartment by the main door, which they locked with the key, turned right, then left, reaching the main road that led to the restaurant in question. They all had breakfast together at the same table, including the children.

When breakfast was over, at about 09H00, the witness took her daughter to the "crèche" next to the "Tapas", while her husband Mathew went with Russel to take his daughter E**a to the "crèche" at the main reception. The witness says she returned to her apartment, did some cleaning and changed clothes as she had scheduled a tennis lesson for 11H00. At 09H45 she left the apartment and went to the swimming pool area where she read a book and talked with Kate until about 11H10, the time that she left for the tennis courts as the lesson was slightly delayed. At that time her husband Mathew arrived also to play tennis until about 12.10 pm.

When the lesson finished, they collected their daughter and went to David and Fiona Payne’s apartment, where they all lunched together. At 13h45, the three returned to their apartment, where they put their daughter to bed who slept for about two hours. The witness went to play tennis with Jane until 15.00, while her husband Mathew went to Russel’s balcony to talk, or vice versa, she doesn't know exactly, their apartment being located to the side of theirs and there is only one other apartment between the two.

After the game of tennis, the witness returned home to rest, her husband and Russel having gone to the beach of Luz to sail. At about 15:45, her daughter having woken up, she took her to the beach of Luz in the company of Diane, Jane, Fiona and their respective children, where they found Mathew, Russel and David. At 17H30 the children dined in one of restaurants by the beach, not having detected any abnormal or strange situation.

At about 18:30, the women and children returned from the beach in the direction of the "OCEAN CLUB" with a view to seeing their husbands play tennis, who had returned from the beach about five minutes before. Until going to the apartment she was with the children in the playground area, next to the "Tapas", until about 19.00.

Then she went to the apartment where she gave her daughter a bath, Mathew returning at 19.15. They washed and put their daughter to bed by 19:45. The witness and her husband took a bath, dressed and went to the restaurant "TAPAS" at about 20H40. They left by the main door, which they locked, arriving at the "TAPAS" about two minutes later. She emphasised that the back door was closed and properly locked.

When she arrived at the restaurant, Kate, Gerald and Jane were already there and were talking to another couple who was not part of the group. Russel had not yet arrived because he was getting his daughter to sleep, according to what Jane told her.

The witness states that she sat more or less facing the back of the apartment and Mathew, on the side of the table, on her left. She does not know if, from that position, he could the back door of the apartment where Madeleine was, but if this had been the case then he would only have been able to see the very top.

Then Russel arrived and after another 10 minutes, when it would be around 20H55, the Payne family - David, Fiona and Diane - arrived. About a minute before the Payness arrived, her husband Mathew got up from the table and said he was going to go and look for them, taking the opportunity to “listen” to the children. She say that, according to what they told her, they passed Mathew on their way. After about 4 minutes, Mathew returned to the table when they ordered the food, and said he had "listened" to his daughter and to the Russel and McCann children, outside the front by putting his head against the shutters of the windows of their respective bedrooms and that everything was calm with the children. Both ate fish and salad, the witness drank white wine and Mathew red wine, she thought that, at that moment, one glass each.


At about 21.05, Gerald went see his children, and about 10 minutes later Jane left before GM had returned. A few minutes after Jane left Gerald arrived and said he had been talking to "Jez" about tennis, she does not remember if he said anything about the children. During this time she states that no one else left the table. Two or three minutes after Gerald’s arrival, Jane arrived, the witness does not remember whether Jane made any comment about her children either.

At 21H20 they began to dine, and, at 21.30, her husband Mathew said that he would go to see his daughter, G***e. The witness offered to go in his place, but he did not accept. Russel also stood up saying that he would also go to see his children. When they had both got up from the table, Kate said the same, namely, that she would also go to see her children. At that point, she presumes, she cannot be sure, if her husband Mathew or Russel volunteered to go to see Kate's children, and she them that they would have to enter by the back door, which was unlocked. Russel and Mathew left at the same time. About five minutes later, Mathew returned saying that the children were all well, and that Russel had stayed in the bedroom as one of his daughters was crying.

At about 21H40/21H45, when they were at dinner, Jane said that she was going to replace Russel so that he could dine, since she had already eaten. About five minutes later Russel returned to the table saying that his daughter E**e was sick and had vomited, and he started to dine afterwards.

At about 21H55/22H00 Kate got up from the table and went alone to her apartment in order to see her children. Five to ten minutes later, she returned the table, crying, visibly shaken, saying that Madeleine had disappeared. Immediately, all the members of the group, except Diane, stood up heading for the apartments, and the witness went to see if her daughter was well. Soon after, the men of the group started to do a search around the apartments in an attempt to find the child, at which time the Kate said that the window and the shutters of Madeleine's bedroom were open and, as such, she had been taken by someone.

The witness states that she did not enter Madeleine’s bedroom, thinking that Mathew her husband, had not done so either. Then, they extended the search to more distant areas, and her husband headed to the main reception to see if Madeleine was there, since her "crèche" was there, that also being the place from where he contacted the local police authorities.

They continued the search with the help of more people, which resulted in nothing. Further that, about 10 minutes after Kate raised the alarm about the disappearance, the witness went to see Jane in her apartment. While talking, Jane told her that when she came to see their children and passed Gerald talking to "Jez", she saw a man carrying a child, supported in the arms, which would not be a baby and could have been more or less Madeleine’s age. Also she said that when she saw the man, it seemed strange because he was walking very fast and the child was wearing pyjamas, without any other piece of clothing. That when the witness questioned her, Jane told her that at the time she had said nothing because she knew nothing of the disappearance of Madeleine and she had not seen the child’s face. When asked, says that, initially Jane focused more on the description of the man and, only a few days later, did she make reference to the clothes that the child was wearing, which were pyjamas, not recalling if she made a comprehensive description of clothing, especially regarding the colour or design.

When questioned, she said that on Thursday, 03/05/2007, there was nobody sitting at the table, who was unknown to the group, and she does not know anyone with the name "IRWIN."

She added that it was David Payne who organised this trip, and the apartment where she was staying had already been allocated to her at the time she checked in, not having been given any possibility for choice.

She does not have any suspicion in relation to the facts under investigation, stressing that in the holiday period prior to the day of the disappearance she did not find anything abnormal or strange.

Concerning the monitoring of the children every half hour, it was inspired by the system that "Mark Warner" has and which is known as "baby listening" and she had used this service in 2006 when they stayed at a holiday resort in Greece.
When questioned, said that no member of the group rented, or was transported in a vehicle, movements were always made on foot, they only travelled by bus on the day of arrival, on the route between the Faro airport and the "Ocean Club."

She got to know the McCann family at the marriage of David and Fiona, in Italy in 2003, at which time Madeleine was already 4 months old. She does not know them to have any enemies.
She has no knowledge, in addition to their group, of other friends of Madeleine’s family, who may have been in Portugal during the period when the facts occurred.

That, in the photographs she took during this holiday, only the various members of the group are recorded. When questioned, she states that during the holiday period she went to lunch at the apartment of David and Fiona, and that Madeleine had at no moment entered the witness’s apartment.

When questioned, she said that on the day they arrived, her husband Mathew felt sick with diarrhoea and vomiting, a situation that lasted until Sunday morning. She adds, on Wednesday, in the early morning, she also felt sick with the same symptoms.

No more is said. She reads the statement, agrees, ratifies and signs.

Que confiana integra as declarações que prestou neste Departamento Policial no pretérito dia 04/05/2007, encontrando-se disponível para prestar quaisquer esclarecimentos adicionais. -------
----- Ficou alojada no apartamento "5B", o qual se situa imediatamente ao lado do apartamento da família MCCANN. Que, no dia 03/05/2007, Quinta-feira, se levantou entre as 06H30 e as 07H00, juntamente com o seu marido MATHEW e a sua filha G***e, de 19 meses de idade. -------------
----- Pelas 07H50, dirigiram-se para o restaurante "MILLENIUM", a pé, onde terão chegado pelas 08H00, a fim de tomar o pequeno almoço. Refere que terão sido os primeiros elementos do grupo a chegar, sendo que, posteriormente, chegaram o DAVID e a FIONA, e os dois filhos, o RUSSEL com seus filhos. A JANE não veio porque nessa manhã não se sentia bem Fizeram o trajecto
normal, sozinhos, tendo saído do apartamento pela porta principal, que fechou com a chave, contornado a direita, logo após, a esquerda, acedendo à estrada principal e que dá acesso ao referido restaurante. Tomaram o pequeno almoço todos juntos na mesma mesa, inclusive as crianças ----- Terminado o pequeno almoço, pelas 09H00, a depoente foi levar a sua filha a "creche" junto
ao "TAPAS", enquanto o seu marido MATHEW, foi com o RUSSEL levar a filha E**a à "creche" junto da recepção principal. A depoente diz ter regressado ao seu apartamento, tendo efectuado algumas limpezas e trocado de roupa, uma vez que tinha marcada uma aula de ténis para as llH00. Pelas 093845, saiu do apartamento e deslocou-se para a zona da piscina, onde esteve a
ler um livro e a falar com a KATE, até cerca das llH10, altura em que se deslocou para junto dos courts de ténis, urna vez que aula se atrasou ligeiramente. Neste momento, chegou o seu marido MATHEW que também esteve a jogar ténis, até cerca das 12H10. ....
----- Terminada a aula, pegaram na filha e foram para o apartamento do DAVID PAYNE e da FIONA, onde almoçaram todos juntos. Pelas 13H45, regressaram os três ao seu apartamento, onde deitaram a sua filha, que dormiu cerca de duas horas. A depoente foi jogar ténis com a JANE até às 15H00, enquanto o seu marido MATHEW foi para a varanda do RUSSEL conversar, ou viceversa,
não sabe precisar, sendo que este apartamento fica ao lado do seu, existindo apenas um outro apartamento entre 0s dois. ..........
----- Após o jogo de ténis, a depoente regressou a casa para descansar, tendo o seu marido e o RUSSEL ido para a praia da Luz velejar. Cerca das 15H45, a sua filha acordou, levando-a para a praia da Luz, na companhia da DIANE, JANE, FIONA e dos seus respectivos filhos, onde se encontraram com o MATHEW, RUSSEL e o DAVTD. Pelas 17H30, as crianças jantaram num
dos restaurantes junto à praia, não tendo detectado qualquer situação estranha ou anormal. ----------
----- Pelas 18H30, as mulheres e as crianças regressaram da praia em direcção ao "OCEAN CLUB", com o intuito verem os maridos a jogarem ténis, os quais regressaram da praia, cerca de cinco minutos antes. Ainda antes de irem para o apartamento, esteve com as crianças na zona de recreio, junto ao "TAPAS", até cerca das 19H00. ...........................................................
----- De seguida, foi para o apartamento, onde deu banho à sua filha, tendo o MATHEW chegado pelas 19H15. Fizeram a higiene e puseram a sua filha na cama pelas 19H45. A depoente e o seu marido tomaram banho, vestiram-se e foram para o restaurante "TAPAS" por volta 20H40. Saíram pela porta principal, a qual fecharam à chave, tendo chegado ao "TAPAS" cerca de dois minutos
depois. Salienta que a porta das traseiras, ficou fechada e devidamente trancada. ......................
----- Quando chegou ao restaurante, já ali se encontrava a KATE, o GERALD e a JANE, os quais estavam a falar com um outro casal que não fazia parte do grupo. O RUSSEL ainda não tinha chegado, porque estaria a adormecer a sua filha, segundo foi informada pela JANE. ------------------
----- A depoente refere que se sentou mais ou menos de frente para as traseiras do apartamento e o MATHEW, na lateral da mesa, ti sua esquerda. Não sabe se, daquela posição, conseguia ver a porta das traseiras do apartamento onde se encontrava a MADELEINE, sendo que, em caso apenas conseguia ver o topo superior. ...........................................................
----- De seguida, chegou o RUSSEL e, passados 10 minutos, quando seriam cerca de 20H55, chegou a família PAYNE, DAVID, FIONA e DIANE. Cerca de um minuto antes da família PAYNE chegar, o seu marido MATHEW levantou-se da mesa e disse que ia procurá-los, aproveitando para "escutar" as crianças. Refere que, segundo o que estes lhe transmitiram, ter-se-ão cruzado com o MATHEW durante o trajecto. Decorridos cerca de 4 minutos, o MATHEW regressou a mesa, altura em que encomendaram a comida, tendo referido que havia "escutado" a sua filha e as crianças RUSSEL e MCCANN, pela frente do lado exterior, encostando a cabeça aos estores das janelas do respectivos quartos e que estava tudo calmo com as crianças. Ambos comeram peixe e salada, tendo a depoente bebido vinho branco e o MATHEW, vinho tinto, pensa que, até este momento, um copo cada um. ......
----- Pelas 21H05, o GERALD foi ver os seus filhos e, cerca de 10 minutos depois saiu a JANE, sem que o primeiro ainda tivesse regressando. Alguns minutos depois da JANE sair, chegou o GERALD, que disse que tinha estado a falar com o "JEZ" sobre ténis, não se recordando se disse alguma coisa relativamente às crianças. Durante este tempo, afirma que mais ninguém saiu da mesa. Dois ou três minutos depois da chegada do GERALD, chegou a JANE, não se recordando igualmente se a mesma fez algum comentário sobre os seus filhos. .......................................
----- Pelas 21H20 começaram a jantar, sendo que, pelas 21H30, o seu marido MATHEW, disse que ia ver a sua filha G***e. A depoente ofereceu-se para ir em seu lugar, mas este não aceitou.
O RUSSEL ter-se-á igualmente levantado, dizendo que também ia ver os seus filhos. Quando já os dois se tinham levantado da mesa, a KATE referiu o mesmo, ou seja, que também ia ver os seus filhos. Nesse momento, presume, não pode assegurar, se o seu marido MATHEW ou o RUSSEL se voluntariaram para ir ver os filhos da KATE, tendo-lhe esta referido que poderia entrar pela
porta das traseiras, a qual estava destrancada. O RUSSEL e o MATHEW saíram ao mesmo tempo.
Cerca de cinco minutos depois, o MATHEW regressou, dizendo que as crianças estavam todas bem, e que o RUSSEL ficou no quarto, uma vez que uma das suas filhas estava a chorar. ------------
-----Pelas 21H40121H45, quando se encontravam a jantar, a JANE disse que ia substituir o RUSSEL para que este pudesse jantar, uma vez que esta já o tinha feito. Cerca de cinco minutos depois, o RUSSEL regressou a mesa, dizendo que a sua filha E**e estava doente, tendo vomitado, começando a jantar de seguida .-------
----- Cerca das 21H55122H00, a KATE levantou-se da mesa e dirigiu-se sozinha ao seu apartamento, a fim de ver os seus filhos. Cinco a dez minutos depois, regressou a mesa, a chorar, visivelmente abalada, dizendo que a MADELEINE tinha desaparecido. De imediato, todos os elementos do grupo, a excepção da DIANE, se levantaram, dirigindo-se para junto dos apartamentos, tendo a depoente ido verificar se a sua filha se encontrava bem. Logo após, os homens do grupo começaram a fazer uma busca à volta dos apartamentos, numa tentativa de encontrar a criança, momento em que a KATE disse que a janela e o estores do quarto da
MADELEINE estavam abertos e, como tal, ela tinha sido levada por alguém. .........................
----- A depoente refere que não chegou a entrar no quarto da MADELEINE, pensando igualmente que o seu marido MATHEW também não o tenha feito. Em seguida, estenderam as buscas até zonas mais distantes, tendo o seu marido se dirigido à recepção principal para ver se aí se encontrava a MADELEINE, já que aí existe uma "creche", sendo também nesse local que ele
contactou as autoridades policiais locais. ..................
----- Continuaram as buscas com a ajuda de mais pessoas, que em nada resultaram. Refere ainda que, cerca de 10 minutos depois da KATE dar o alarme do desaparecimento, a depoente foi ter com a JANE ao apartamento desta. Ao conversarem, a JANE disse-lhe que, quando veio ver os seus filhos e se cruzou com o GERALD a falar com o "JEZ", viu um homem com uma criança ao colo, suportada nos braços, que não seria um bebé e que poderia ter mais ou menos a idade da MADELEINE. Disse ainda que, quando viu o homem, lhe pareceu estranho, porque ele estava a andar muito depressa e a criança teria um pijama vestido, sem qualquer outra peça de roupa. Que ao questioná-la, a JANE terá dito à depoente que, na altura não comentou nada, porque ainda não
se sabia do desaparecimento da MADELEINE e ela não tinha visto a cara da criança. Perguntado, refere que, numa primeira fase a JANE se centrou mais na descrição do homem e, só alguns dias mais tarde, é que terá feito referência à roupa que a criança teria vestida, que seria um pijama, não se recordando se chegou a fazer uma descrição exaustiva do vestuário, nomeadamente, ao nível da cor ou desenhos. ..................
----- Perguntado, refere que, na quinta-feira, dia 03/05/2007, não estava ninguém sentado na mesa estranho ao grupo, sendo que não conhece qualquer pessoa com o nome "IRWIN". -------------
----- Acrescenta que foi o DAVID PAYNE que organizou esta viagem, sendo que o apartamento onde se encontra já lhe estava destinado, no momento em que efectuou o ckek in, não Ihes tendo sido &da qualquer possibilidade de escolha. .................................................................
----- Refere não possuir qualquer tipo de suspeita, relativamente aos factos em investigação, salientando que, no período de férias que antecedeu o dia do desaparecimento, não detectou nada de anormal ou estranho. ----- No que conceme à vigilância de meia em meia hora feita às crianças, surgiu por inspiração do sistema que a "MARK WARNERS" possui e que se designa por "baby listening", tendo já usufruído desse serviço, durante o ano 2006, quando gozaram férias num resort na Grécia. ----------
----- Perguntada, disse que nenhum elemento do grupo alugou, ou se fez transportar num veículo, pelo que as deslocação eram sempre feitas a pé, somente andaram de autocarro no dia da chegada, no trajecto entre o Aeroporto de Faro e o ''OCEAN CLUB". ----- Que travou conhecimento com a família MCCANN, no casamento do DAVID e da FIONA, em Itália, no ano de 2003, sendo que nessa altura a MADELEINE já tinha 4 meses de idade. Não fies conhece quaisquer inimigos. ----- Não tem conhecimento, para além do seu grupo, de outras pessoas amigas da família da MADELEINE, que possam ter estado em Portugal, durante o período em que ocorreram os factos.
----- Que, nas fotografias que tirou durante o presente período de férias, apenas se encontram registados os vários elementos do grupo. Perguntada, refere que, durante o período de férias foi almoçar ao apartamento do DAVID e FIONA, sendo que a MADELEINE em momento algum entrou no apartamento & depoente. ----- Perguntada, disse que, no dia em que chegaram, o seu marido MATHEW sentiu-se doente, com diarreia e com vómitos, situação que se prolongou até Domingo de manhã. Acrescenta que, na Quarta-feira, de madrugada, também ela própria se sentiu doente com os mesmos sintomas.
