The McCanns yesterday demanded to be cleared over daughter Madeleine's disappearance as a legal chief ruled there was no evidence against them.
Portimao district attorney Jose Magalhaese Meneses admitted there was nothing to implicate them after reviewing the six-month police probe.
A friend of Kate and Gerry, both 39, said: "They are adamant they should now be cleared."
The couple's spokesman Clarence Mitchell added: "If the reports are true clearly it would indicate the police absolutely, and quite rightly, have no case against Kate and Gerry.
"In these circumstances there's nothing for them to do but to release them from their arguido status immediately."
The couple were made official suspects two months ago and quizzed separately by Portuguese police over two days.
But yesterday Mr Meneses banned detectives from reinterrogating them.
This comes after the admission that all the DNA evidence, analysed in Lisbon and Birmingham, was contaminated because police failed to properly secure the crime scenes.
Original suspect British expat property developer Robert Murat, 33, is to be grilled again.
And yesterday police re-interviewed dozens of witnesses, including staff at the Ocean Club tapas bar in Praia da Luz, where Kate and Gerry dined on May 3, the night Madeleine vanished.
